A BILL

TO AMEND SECTION 50-13-10, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LAWFUL METHODS OF CATCHING FISH, SO AS TO PROVIDE THAT NOT MORE THAN THREE RATHER THAN TWO DEVICES PERMITTED TO BE USED TO CATCH FISH MAY BE USED BY ANY ONE INDIVIDUAL WHILE FISHING; AND TO AMEND SECTION 50-13-11, AS AMENDED, RELATING TO THE USE OF UNLIMITED NUMBER OF FISHING DEVICES, SO AS TO PROVIDE THAT ANY PERSON FISHING IN A BOAT IN SALT WATER MAY USE AN UNLIMITED NUMBER OF FISHING DEVICES AS PROVIDED IN THE SECTION.

    Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-13-10 of the 1976 Code, as last amended by Act 181 of 1994, is further amended to read:

    "Section 50-13-10.    The catching of game fish in all fresh waters of the State shall be only with hook and line, fly rod, casting rod, pole and line and hand line. Not more than two eight of the above-mentioned devices may be used by any one individual while fishing."

SECTION    2.    Section 50-13-11 of the 1976 Code, as last amended by Act 181 of 1993, is further amended to read:

    "Section 50-13-11.    Notwithstanding the provisions of Section 50-13-10, any person fishing in a boat in salt water as defined in Section 50-5-15 may use an unlimited number of lawful fishing devices so long as every other occupant of the boat who, if fishing would be required by law to have a fishing license, has in his possession a valid fishing license."

SECTION    3.    This act takes effect upon approval by the Governor.
