AN ACT TO AMEND SECTION 59-19-45, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ORIENTATION FOR SCHOOL DISTRICT BOARDS OF TRUSTEES AND COUNTY BOARDS OF EDUCATION, SO AS TO REQUIRE THE STATE DEPARTMENT OF EDUCATION TO KEEP A RECORD OF THE TRUSTEES WHO COMPLETE THE ORIENTATION PROGRAM; TO AMEND SECTION 59-18-900, AS AMENDED, RELATING TO THE DEVELOPMENT AND CONTENT OF ANNUAL REPORT CARDS FOR SCHOOLS AND SCHOOL DISTRICTS, SO AS TO REQUIRE THE PERCENTAGE OF NEW TRUSTEES WHO COMPLETE THE ORIENTATION PROGRAM TO BE REFLECTED IN THE DISTRICT'S ANNUAL REPORT CARD; AND TO ADD SECTION 59-40-200 SO AS TO PROVIDE THAT IF A PROVISION IN THE SOUTH CAROLINA CHARTER SCHOOL ACT OF 1996 IS FOUND UNCONSTITUTIONAL, THE REMAINING PROVISIONS OF THAT ACT ARE VALID AND ARE NOT AFFECTED BY THE UNCONSTITUTIONAL PROVISION.
Be it enacted by the General Assembly of the State of South Carolina:
Records of completion of trustee orientation to be maintained
SECTION 1. Section 59-19-45 of the 1976 Code, as added by Act 155 of 1997, is further amended by adding:
"(F) The State Department of Education must keep a record of the school board trustees who complete the orientation program."
School district report card to reflect orientation program completion
SECTION 2. Section 59-18-900 of the 1976 Code, as last amended by Act 40 of 2001, is further amended by adding:
"(F) The percentage of new trustees who have completed the orientation requirement provided in Section 59-19-45 must be reflected on the school district report card."
Severability
SECTION 3. The 1976 Code is amended by adding:
"Section 59-40-200. If any section, subsection, paragraph, subparagraph, provision, or portion of this chapter is held to be unconstitutional or invalid by a court of competent jurisdiction, such holding shall not affect the constitutionality or validity of the remaining portions of this chapter."
Time effective
SECTION 4. This act takes effect upon approval by the Governor.
