A JOINT RESOLUTION TO DIRECT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO CEASE ISSUING NEW AMBULANCE LICENSES FOR MORE THAN ONE HUNDRED TWENTY DAYS OR UNTIL THE DEPARTMENT HAS THE NECESSARY PERSONNEL TO ENFORCE EXISTING LICENSURE REQUIREMENTS, TO PROVIDE AN EXCEPTION IF A DEMONSTRATED NEED EXISTS, AND TO PROVIDE LICENSURE RENEWAL REQUIREMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

Temporary moratorium on issuing new ambulance service licenses

SECTION    1.    (A)    Notwithstanding any other provision of law, the Department of Health and Environmental Control, Division of Emergency Medical Services shall cease issuing new ambulance service licenses for no more than one hundred twenty days from the effective date of this joint resolution or until the department has the necessary personnel to enforce existing licensure requirements. However, the department has the authority to issue a license to a new emergency 911 provider if a demonstrated county emergency need exists due to nonavailability of 911 emergency medical services coverage as determined by the Division of Emergency Medical Services.

(B)    Upon renewal of an ambulance service license that is in existence on the effective date of this joint resolution, the requirements that the licensee must satisfy include, but are not limited to, the following:

(1)    provide evidence, satisfactory to the department, of having one million dollars in liability insurance coverage and one million dollars in medical malpractice insurance;

(2)    meet all ambulance safety and certification requirements established by the department in regulation.

Time effective

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
