A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 10-1-210 SO AS TO PROHIBIT THE NAMING OF A BUILDING, PART OF A BUILDING, OR PART OF THE STATE HIGHWAY SYSTEM FOR A STATE OFFICER UNLESS THE PERSON TO BE HONORED HAS NOT OCCUPIED A STATE OFFICE FOR AT LEAST FIVE CONSECUTIVE YEARS BEFORE THE TIME OF THE NAMING AND TO PROVIDE APPLICABLE DEFINITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 10 of the 1976 Code is amended by adding:

"Section 10-1-210.    A public building or part of a public building owned or leased by the State or a part of the state highway system may not be named for a living person who has served as a state officer unless at the time of the naming the person to be honored has not occupied a state office for at least five consecutive years.

For purposes of this section:

(1)    a state officer is a member of the General Assembly, a statewide elected constitutional officer, a member of a state board, committee, or commission, and a state agency head appointed as provided in Section 1-30-10(B)(1)(i); and

(2)    the time of naming is the date official action is taken directing the naming."

SECTION    2.    This act takes effect upon approval by the Governor and applies with respect to buildings and parts of the state highway system not yet officially named for a living person as of this date.
