A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 49-1-70 SO AS TO PROVIDE THAT REQUIRED BACKFLOW PREVENTION DEVICES CURRENTLY REQUIRED TO BE TESTED MUST NOT BE REQUIRED TO BE TESTED MORE THAN ONCE EVERY TEN YEARS IF TEST RESULTS FOR A DEVICE ARE POSITIVE TWO CONSECUTIVE YEARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 49 of the 1976 Code is amended by adding:

"Section 49-1-70.    Notwithstanding any other provision of law, a backflow prevention device that currently is required by law or regulation to be tested annually must not be required to be tested more than once every ten years if test results for the device are positive two consecutive years."

SECTION    2.    This act takes effect upon approval by the Governor.
