A JOINT RESOLUTION

TO PROVIDE THAT THE IMPOSITION OF THE MOTOR FUELS USER FEE PURSUANT TO CHAPTER 28, TITLE 12 OF THE 1976 CODE IS SUSPENDED EFFECTIVE JUNE 1, 2009, THROUGH SEPTEMBER 1, 2009, AND TO PROVIDE THAT THE OFFSET AMOUNT OF UNOBLIGATED ENFORCED COLLECTIONS REVENUE MUST BE CREDITED TO THE STATE HIGHWAY FUND, AND TO PROVIDE THAT MOTOR FUEL WHOLESALERS MUST PASS ON THE SAVINGS REALIZED BY THIS SUSPENSION OF THE MOTOR FUELS USER FEE TO MOTOR FUEL RETAILERS WHEN INVOICING THEM FOR THE COST OF MOTOR FUELS DURING THE SUSPENSION PERIOD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The imposition of the motor fuels user fee pursuant to Chapter 28, Title 12 of the 1976 Code is suspended effective June 1, 2009, through September 1, 2009. Motor fuel wholesalers must pass on the savings realized by this suspension of the motor fuels user fee to motor fuel retailers when invoicing them for the cost of motor fuels during the suspension period.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
