The Senate assembled at 11:00 A.M., the hour to which it stood adjourned, and was called to order by the PRESIDENT.

A quorum being present, the proceedings were opened with a devotion by the Chaplain as follows:

/   SECTION   1.   Section 50-21-133 of the 1976 Code, as added by Act 124 of 1999, is amended to read:

"Section 50-21-133.   (A)   There is established a no wake zone to begin at Nautical Day Marker Number 125 at Cove Inlet running to a line perpendicular to the westernmost tip of Sullivan's Island where the Intracoastal Waterway joins the Charleston Harbor. These boundaries must be clearly marked by signs. The signs must be designed and installed as specified by the department.

(B)   There is established a no wake zone to begin one hundred yards on either side of a dock or pier at Cherokee Plantation on the Combahee River in Colleton County. These boundaries must be clearly marked by signs. The signs must be designed and installed as specified by the department.

(C)   A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be punished by a fine of two hundred fifty dollars or imprisonment for a period not exceeding ten days, or both. For a second or subsequent offense, the punishment is a fine of five hundred dollars or imprisonment for a period not exceeding thirty days, or both as provided in Section 50-21-150."

SECTION   2.   This act takes effect upon approval by the Governor./

Subsequent to the election of Commissioners to the Consumer Affairs Commission, the PRESIDENT announced that it had convened under the terms of a Concurrent Resolution adopted by both Houses:

S. 1286 (Word version) -- Senators McConnell, Saleeby and Moore: A CONCURRENT RESOLUTION TO FIX WEDNESDAY, MAY 24, 2000, IMMEDIATELY FOLLOWING THE ELECTION OF COMMISSIONERS TO THE SOUTH CAROLINA CONSUMER AFFAIRS COMMISSION, AS THE TIME FOR ELECTING A SUCCESSOR TO A CERTAIN JUDGE OF THE CIRCUIT COURT FOR THE FIFTH JUDICIAL CIRCUIT, SEAT 3, WHOSE UNEXPIRED TERM EXPIRES JUNE 30, 2003; AND TO ELECT A SUCCESSOR TO A CERTAIN JUDGE OF THE CIRCUIT COURT, AT-LARGE SEAT 3, WHOSE UNEXPIRED TERM EXPIRES JUNE 30, 2003.

The PRESIDENT announced that nominations were in order to elect a successor to the position of Judge, 5th Judicial Circuit, Seat #3.

Representative Delleney, Chairman of the Judicial Screening Committee, indicated that the Honorable Ralph King "Tripp" Anderson, III, Mr. G. Thomas Cooper, Jr. and Mr. Grady L. "Leck" Patterson, III had been screened and found qualified to serve.

On motion of Representative Delleney, the names of the Honorable Ralph King "Tripp" Anderson, III and Mr. Grady L. "Leck" Patterson, III were withdrawn from consideration.

Representative Delleney placed the name of Mr. G. Thomas Cooper, Jr. in nomination.

Representative Delleney moved that the nominations be closed and, with unanimous consent, the vote was taken by acclamation, resulting in the election of the nominee.

Whereupon, the PRESIDENT announced that the Honorable G. Thomas Cooper, Jr. was elected to the position of Judge, 5th Judicial Circuit, Seat #3 for the term prescribed by law.

Election to the Position of

The PRESIDENT announced that nominations were in order to elect a successor to the position of Judge, Circuit Court, At-Large, Seat #3.

Representative Delleney, Chairman of the Judicial Screening Committee, indicated that Ms. Lisa G. Collins, Mr. Edward W. "Ned" Miller and Mr. Clifton Newman had been screened and found qualified to serve.

On motion of Representative Delleney, the names of Ms. Lisa G. Collins and Mr. Edward W. "Ned" Miller were withdrawn from consideration.

On motion of Representative Delleney, the name of Mr. Clifton Newman was placed in nomination.

Representative Delleney moved that the nominations be closed and, with unanimous consent, the vote was taken by acclamation, resulting in the election of the nominee.

Whereupon, the PRESIDENT announced that the Honorable Clifton Newman was elected to the position of Judge, Circuit Court, At-Large, Seat #3 for the term prescribed by law.

Election to the Old Exchange Building Commission

Subsequent to the judicial elections, the PRESIDENT of the Senate announced that it had convened under the terms of a Concurrent Resolution adopted by both Houses:

S. 1392 (Word version) -- Senator Leventis: A CONCURRENT RESOLUTION TO FIX 12:00 NOON ON WEDNESDAY, MAY 24, 2000, IMMEDIATELY FOLLOWING THE ELECTION OF MEMBERS OF THE CONSUMER AFFAIRS COMMISSION AS THE TIME FOR ELECTING A MEMBER OF THE OLD EXCHANGE BUILDING COMMISSION TO SUCCEED THE HONORABLE JAMES M. EAVES WHO HAS RESIGNED DUE TO FAMILY HEALTH REASONS.

The PRESIDENT announced that nominations were in order to elect a successor to a position on the Old Exchange Building Commission.

On motion of Senator LEVENTIS, with unanimous consent, the Concurrent Resolution was amended to include an election for three positions on the Old Exchange Building Commission.

Senator LEVENTIS indicated that Mrs. Louise Burgdorf of Springfield, S.C., Captain John S. Coussons of Charleston, S.C., and Ms. Retta Sanders of Sumter, S.C., had been screened and found qualified to serve.

On motion of Senator LEVENTIS, the names of Mrs. Louise Burgdorf, Captain John S. Coussons and Ms. Retta Sanders were placed in nomination.

Senator LEVENTIS moved that the nominations be closed and, with unanimous consent, the vote was taken by acclamation, resulting in the election of the nominees.

Whereupon, the PRESIDENT announced that the Honorable Louise Burgdorf, the Honorable John S. Coussons and the Honorable Retta Sanders were elected to three positions on the Old Exchange Building Commission for the terms prescribed by law.

Election to the Legislative Audit Council

Subsequent to the election to the Old Exchange Building Commission, the PRESIDENT of the Senate announced that it had convened under the terms of a Concurrent Resolution adopted by both Houses:

S. 1379 (Word version) -- Senators Peeler, Wilson and Martin: A CONCURRENT RESOLUTION TO FIX WEDNESDAY, MAY 24, 2000, IMMEDIATELY FOLLOWING THE ELECTION OF A MEMBER OF THE SOUTH CAROLINA CONSUMER AFFAIRS COMMISSION AS THE TIME FOR THE HOUSE OF REPRESENTATIVES AND THE SENATE TO MEET IN JOINT ASSEMBLY IN THE HALL OF THE HOUSE OF REPRESENTATIVES TO ELECT A SUCCESSOR TO THE MEMBER OF THE LEGISLATIVE AUDIT COUNCIL WHOSE TERM EXPIRED MAY 9, 1999.

The PRESIDENT announced that nominations were in order to elect a successor to the position on the Legislative Audit Council.

Representative Limehouse indicated that Ms. Nancy Hawk had been screened and found qualified to serve.

On motion of Representative Limehouse, the name of Ms. Nancy Hawk was placed in nomination.

Representative Limehouse moved that the nominations be closed and, with unanimous consent, the vote was taken by acclamation, resulting in the election of the nominee.

Whereupon, the PRESIDENT announced that the Honorable Nancy Hawk was elected to the position on the Legislative Audit Council for the term prescribed by law.

The purposes of the Joint Assembly having been accomplished, the PRESIDENT declared it adjourned, whereupon the Senate returned to its Chamber and was called to order by the PRESIDENT.

At 12:34 P.M., the Senate resumed.
