THE COMMITTEE ON MEDICAL AFFAIRS

To whom was referred a Bill (H. 4094), to amend Section 43-21-40, Code of Laws of South Carolina, 1976, relating to the powers of the South Carolina Commission on Aging, so as to authorize the commission to certify homemakers and home health aides in accordance with the Federal Omnibus Budget Reconciliation Act, etc., respectfully

A BILL

TO AMEND SECTION 43-21-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE POWERS OF THE SOUTH CAROLINA COMMISSION ON AGING, SO AS TO AUTHORIZE THE COMMISSION TO CERTIFY HOMEMAKERS AND HOME HEALTH AIDES IN ACCORDANCE WITH THE FEDERAL OMNIBUS BUDGET RECONCILIATION ACT AND ESTABLISH AND COLLECT FEES FOR ADMINISTERING THIS CERTIFICATION PROGRAM AND CARRY FORWARD REMAINING FEES TO THE NEXT FISCAL YEAR FOR THE SAME PURPOSE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The last paragraph of Section 43-21-40 of the 1976 Code is amended by adding an appropriately lettered item to read:

"( ) Certify homemakers and home health aides pursuant to the Federal Omnibus Budget Reconciliation Act of 1987 and subsequent amendments to that act and through regulations promulgated in accordance with the Administrative Procedures Act establish and collect fees for the administration of this certification program. Fees collected must be placed on deposit with the State Treasurer. Accounting records must be maintained in accordance with the Comptroller General's policies and procedures. Unused fees may be carried forward to the next fiscal year for the same purpose."

SECTION 2. This act takes effect upon approval by the Governor.
