The Senate assembled at 12:00 Noon, the hour to which it stood adjourned and was called to order by the PRESIDENT.

A quorum being present the proceedings were opened with a devotion by the Chaplain as follows:

Let us pray.

Great and infinite Lord God, we praise Thee for Thy glory manifested in the regular return of springtime. Each year... after the wintertime... You provide a blessed new season we call spring.

We are awed by the majesty of the creative power that set the cosmic systems into being. We marvel that for thousands of years... on a regular basis... the seasons have followed each other. Each season brings its own special blessing to the creatures of our planet.

Today, make us wise enough to be humble... and smart enough to trust more in the Spirit's guidance than in our own cleverness.

We pray in the Name of the God that sent Abraham into new vistas... and Noah into a fresh new world... that we may in our day see a holy glow over our troubled world.

The House returned the Bill with amendments.

Senator POPE proposed the following amendment (JUD554.001), which was adopted:

Amend the bill, as and if amended, line 38, in Section 22-5-910, as contained in SECTION 1, by inserting after the word /vehicle/ the following:

/or to a violation of Title 50 or the regulations promulgated thereunder for which points are assessed, suspension provided for, or enhanced penalties for subsequent offenses authorized/ .

S. 1417 -- Senator Land: A CONCURRENT RESOLUTION TO EXTEND THE DEEPEST SYMPATHY OF THE MEMBERS OF THE GENERAL ASSEMBLY TO THE FAMILY AND MANY FRIENDS AND ADMIRERS OF JAMES R. BURROWS OF SUMTER WHO DIED WEDNESDAY, MARCH 4, 1992.

On immediate consideration, the Concurrent Resolution was adopted, ordered sent to the House.

S. 1418 -- Senator Pope: A CONCURRENT RESOLUTION TO AUTHORIZE PALMETTO GIRLS STATE TO USE THE CHAMBERS OF THE SENATE AND THE HOUSE OF REPRESENTATIVES AND THE FRONT STEPS OF THE STATE HOUSE ON FRIDAY, JUNE 19, 1992, FOR ITS ANNUAL LEGISLATIVE DAY ACTIVITY.

Be it resolved by the Senate, the House of Representatives concurring:

That Palmetto Girls State is authorized to use the chambers of the Senate and the House of Representatives and the front steps of the State House on Friday, June 19, 1992, from 9:00 a.m. to 4:30 p.m. for its annual legislative day activity. If either House is in statewide session, the chamber of that House may not be used.

Be it further resolved that the State House security forces provide assistance and access as is necessary for this meeting in accordance with previous procedures.

Be it further resolved that no charges may be made for the use of the Senate and House chambers by Palmetto Girls State on these dates.

S. 1419 -- Senators Shealy, Reese, Pope, Hinds, Peeler, Courtney, Setzler, Bryan, Thomas, Giese, Wilson, Macaulay, J. Verne Smith, Moore, Leatherman, Lourie, Passailaigue, Mitchell and Rose: A CONCURRENT RESOLUTION TO REQUEST THE SOUTH CAROLINA DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AND THE HIGHWAY PATROL TO NOTIFY MOTORISTS OF THE INCREASE IN RECOUPMENT FEES FOR VARIOUS TRAFFIC OFFENSES WHEN A DRIVER IS STOPPED FOR AN OFFENSE OF ANY TRAFFIC LAW.

Whereas, the recoupment fees for various traffic offenses has increased; and

Whereas, the motoring public should be informed of the increases in fees for a violation of traffic offenses; and

Whereas, the South Carolina Department of Highways and Public Transportation and the Highway Patrol are best able to inform the public of these increases in a similar manner as drivers are informed of the seat belt law. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly request the South Carolina Department of Highways and Public Transportation and the Highway Patrol to inform motorists of the increase in recoupment fees for various traffic offenses when a driver is stopped for an offense of any traffic law.

Be it further resolved that a copy of this resolution be forwarded to the department.

S. 1420 -- Senator Mitchell: A CONCURRENT RESOLUTION TO DIRECT THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AND THE SOUTH CAROLINA HIGHWAY PATROL NOT TO ENFORCE FOR A PERIOD OF NINETY DAYS THE PROVISIONS OF THE SOUTH CAROLINA COMMERCIAL DRIVER LICENSE ACT WHICH REQUIRE A PERSON DRIVING A COMMERCIAL MOTOR VEHICLE AFTER APRIL 2, 1992, TO HAVE A COMMERCIAL DRIVER'S LICENSE STIPULATED BY THAT ACT.

Whereas, the South Carolina Commercial Driver License Act in Section 56-1-2070 of the 1976 Code provides in part that: "no person may drive a commercial motor vehicle on the highways of this State after April 2, 1992, unless the person has been issued, and is in immediate possession of, a valid commercial driver license and applicable endorsements valid for the vehicle which the person is driving"; and

Whereas, in order for a person to be issued a commercial driver's license by the Department of Highways and Public Transportation under this act he must first pass a knowledge and skills test for driving a commercial motor vehicle; and

Whereas, at the present time a large number of applicants for a commercial driver's license have not been able to comply with these testing requirements due in part to a shortage of testing facilities and personnel; and

Whereas, the members of the General Assembly, by this resolution, express their belief that an additional period of ninety days beyond the April 2, 1992, deadline is needed so that all applicants will have a fair opportunity to secure the required commercial driver's license. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly hereby direct the Department of Highways and Public Transportation and the South Carolina Highway Patrol not to enforce for a period of ninety days the provisions of the South Carolina Commercial Driver License Act which require a person driving a commercial motor vehicle after April 2, 1992, to have a commercial driver's license stipulated by that act.

Be it further resolved that a copy of this resolution be forwarded to the South Carolina Department of Highways and Public Transportation and the South Carolina Highway Patrol.

S. 1421 -- Senator Matthews: A BILL TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING CHAPTER 76 TO TITLE 44 SO AS TO PROVIDE FOR THE LICENSED DIETITIAN/LICENSED NUTRITIONIST ACT BY PROVIDING DEFINITIONS, PROVIDING FOR THE ADVISORY BOARD OF DIETETICS AND NUTRITION, ESTABLISHING RELATED DUTIES FOR THE SOUTH CAROLINA DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, PROVIDING FOR THE PRACTICE OF DIETETICS AND NUTRITION AND THE USE OF THE TITLE `LICENSED DIETITIAN' AND `LICENSED NUTRITIONIST', PROVIDING FOR ELIGIBILITY, LICENSURE, AND EXAMINATION REQUIREMENTS, PROVIDING THE CIRCUMSTANCES UNDER WHICH A PERSON MAY PRACTICE WITHOUT EXAMINATION, AND ESTABLISHING THE PUNISHMENT AND PENALTIES FOR VIOLATIONS; AND TO PROVIDE FOR A STAGGERED INITIAL TERM OF ONE BOARD MEMBER.

S. 1422 -- Senator Pope: A BILL TO AMEND SECTION 56-1-280, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE MANDATORY SUSPENSION OR REVOCATION OF A DRIVER'S LICENSE, SO AS TO PROVIDE THAT IN CASES OF A DISCREPANCY BETWEEN THE PROVISIONS OF THIS SECTION WHICH REQUIRE REVOCATION OF A DRIVER'S LICENSE FOR CERTAIN OFFENSES AND OTHER PROVISIONS OF LAW RELATING TO THESE OFFENSES WHICH REQUIRE SUSPENSION OR CANCELLATION OF THE DRIVER'S LICENSE, THE OTHER PROVISIONS OF LAW REQUIRING SUSPENSION SHALL CONTROL AND TO PROVIDE THAT WHEN A SINGLE ACCIDENT RESULTS IN TWO OR MORE CONVICTIONS REQUIRING MULTIPLE PERIODS OF SUSPENSION, THESE PERIODS OF SUSPENSION SHALL RUN CONCURRENTLY AND NOT CONSECUTIVELY.

/(B), obtain the signature of any registered elector of his respective county showing that he witnessed the applicant's signature, and mail the completed application to the county registration board of the county in which the applicant resides. All completed applications must comply with the requirements of Section 7-5-155(1).

(D) Upon receipt of an application, the county registration board in the county in which the applicant resides must determine if the applicant is qualified and the application is complete. If the county registration board determines that the applicant is qualified and the application is complete, the applicant is deemed registered as of the date determined in Section 7-5-155(a)(1)./

Amend the bill further, as and if amended, page 3, beginning on line 1, in Section 7-5-157(D), as contained in SECTION 1, by striking lines 1 through 7 in their entirety and inserting therein the following:

/If the county registration board determines that the applicant is not qualified or that the application is not complete, the board must notify the applicant and request any additional information, if appropriate./

Hayes, Jr.: A BILL TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 27-21-22 AND 27-21-24 SO AS TO PROVIDE THE MANNER IN WHICH A SHERIFF OR CHIEF OF POLICE SHALL USE ABANDONED OR RECOVERED STOLEN PROPERTY AND PROVIDE FOR THE NOTIFICATION TO OWNERS OF ABANDONED OR RECOVERED STOLEN PROPERTY BY THE SHERIFF OR CHIEF OF POLICE OF A MUNICIPALITY; AND TO AMEND SECTION 27-21-20, RELATING TO THE AUTHORIZATION OF A SHERIFF TO SELL ABANDONED OR RECOVERED STOLEN PROPERTY AT PUBLIC AUCTION WHEN THE OWNER CANNOT BE FOUND AND THE REQUIREMENTS FOR ADVERTISEMENT OF THE SALE AND THE DISPOSITION OF THE PROCEEDS OF THE SALE, SO AS TO REVISE THE PROCEDURE FOR SELLING THIS PROPERTY AND AUTHORIZE THE CHIEF OF POLICE OF A MUNICIPALITY TO SELL THE SAME PROPERTY.
