H 2537 General Bill, By House Labor, Commerce and Industry
A Bill to amend Section 42-9-60, Code of Laws of South Carolina, 1976, relating to the prohibition on Workers' Compensation when injury or death is caused by the intoxication or the wilfulness of the employee, so as to provide that the burden of proof is upon the employer to demonstrate that the employee was intoxicated or wilfully intended to injure or kill himself or another, and provide that, with respect to intoxication, an injured employee may recover if he can demonstrate that his intoxication was not a factor in causing the accident or injury; and to amend Section 42-9-80, relating to burden of proof under certain Code Sections concerning Workers' Compensation, so as to delete the reference to Section 42-9-60.
