H 3038 General Bill, By Wilkins, Hayes and S.S. Wofford
    A Bill to amend Section 62-3-603, as amended, Code of Laws of South Carolina, 1976, relating to the requirements of bond for personal representatives for purposes of the South Carolina Probate Code, so as to eliminate the requirement that a will expressly waive the bond requirement for the personal representative named in the will for there to be no bond required, to eliminate redundant language relating to the bond requirement for the personal representative of an intestate estate, to waive the requirement for bond for a resident personal representative appointed under a will unless the will contains an express requirement of bond, and to give these changes retroactive application to wills probated after July 12, 1988.
