A JOINT RESOLUTION
TO APPROVE REGULATIONS OF THE DEPARTMENT OF
HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO
HAZARDOUS WASTE MANAGEMENT, DESIGNATED AS
REGULATION DOCUMENT NUMBER 1682, PURSUANT TO THE
PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976
CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Health and
Environmental Control, relating to Hazardous Waste Management,
designated as Regulation Document Number 1682, and submitted to the
General Assembly pursuant to the provisions of Article 1, Chapter 23,
Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the
Governor.

SUMMARY AS SUBMITTED BY PROMULGATING
AGENCY. The proposed modifications to the hazardous waste
management regulation are designed to supplement requirements of the
U.S. Environmental Protection Agency Resource Conservation and
Recovery Act of 1976 as amended, Title II, Subtitle C Section 3009, the
South Carolina Hazardous Waste Management Act Section44-56-10 et
seq., and the Pollution Control Act Section48-1-10 et seq., for the
purposes of protecting protect health, safety and the environment. If
approved by the General Assembly, the provisions would be
incorporated into R.61-79 and become effective upon publication in the
State Register.
New provisions would provide for clarity within existing regulation,
including requirements for notarizing existing financial documents;
stipulation by insurers that the insurance policies reflect the
requirements of these regulations; imposition of financial responsibility
for cleanup by commercial offsite treatment/disposal facilities; a
requirement for 10 feet of naturally occurring low-permeability material
beneath landfill liner systems; requirement for containment at interim
status and generators' storage areas; the removal of the requirement for
transporters to report their activities; and extension of the postclosure
permit period from 5 to 10 years.
