B.E. Thrailkill and J.H. Toal
A Bill to amend Section 56-5-2930, Code of Laws of South Carolina, 1976,
relating to the crime of driving under the influence, so as to redefine the
crime; and to amend Section 56-5-2940, as amended, relating to the penalties
for violating Section 56-5-2930 and subsequent offenses, so as to impose
minimum prison sentences of not less than forty-eight hours for second, third,
fourth, or subsequent offenses in addition to the monetary fines, permit the
suspension of the minimum sentence for a second offense, provide that, in that
case, the court may require the offender to complete forty-eight hours of
public service in the county where the person is convicted, enters a plea of
guilty or nolo contendere, or forfeits bail, or in another county, provide a
definition of "public service" and "community service program", and add the
plea of nolo contendere for purposes of determining prior offenses.
