H 3250 General Bill, By F.L. Day
A Bill to amend Section 14-7-1110, Code of Laws of South Carolina, 1976,
relating to peremptory challenges in criminal cases in circuit courts, so as
to change the reference to "rape" to "criminal sexual conduct", to increase
the State's challenges from five to ten, to provide that, when more than one
defendant is jointly tried, the State is entitled to not more than twenty
challenges, and to delete the provisions allowing no more than ten challenges
to defendants jointly tried for misdemeanors and allowing ten challenges to
the State in felonies when the defendants are jointly tried; to amend Section
14-7-1120, relating to peremptory challenges and strikes in criminal cases in
circuit courts for alternate jurors, so as to increase the prosecution's
challenges from one to two; and to repeal Section 14-9-200 relating to
peremptory challenges in criminal cases in county courts.
