A Bill to amend Sections 5-3-50, Code of Laws of South Carolina, 1976,
relating to the certification of a petition signed by a majority of
freeholders in an area desiring to be annexed to a municipality, so as to
change Code Section references and delete the requirement that an election be
held in the corporate limits of the annexing municipality; 5-3-60, relating to
the notice of the annexation election held under the provisions of Section
5-3-20, so as to delete the requirement that the notice be posted in three
conspicuous places in the corporate limits of the municipality; 5-3-70 and
5-3-80, relating to the conduct and results of the election initiated pursuant
to the provisions of Section 5-3-20, so as to delete references to the
election being conducted and votes being counted within the annexing
municipality; 5-3-150, relating to the method of annexation requiring a
petition signed by freeholders residing in the area to be annexed , so as to
reduce the requirement; 5-3-160, relating to the alternate method of annexing
adjacent territory by a municipality, so as to delete the requirement that a
freeholder referendum be conducted; 5-3-180, relating to the method of
counting votes in a referendum and election conducted under the provisions of
Section 5-3-160, so as to delete the requirement that freeholders must approve
the annexation in order for it to be valid; Section 5-3-210, relating to a
subsequent election after defeat of an annexation election, so as to delete
the requirement that an election be conducted inside the annexing
municipality; by adding Sections 5-3-15 through 5-3-18 so as to establish
additional procedures and criteria by which municipalities may annex
contiguous areas; and to repeal Sections 5-3-170 relating to the referendum
required in an area proposed to be annexed under the provisions of Section
5-3-160; and 5-3-200 relating to the requirement that the County Auditor
furnish a list of freeholders to the Commissioners of Elections.
