A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-7-79 SO AS TO REQUIRE A STATEMENT OF OBJECTIVES AND PreviousANNUALNext MEASURES OF PROGRESS FOR ATTAINING THESE OBJECTIVES FOR NEW RECURRING PROGRAMS IN THE PreviousANNUALNext GENERAL APPROPRIATIONS ACT AND FOR INCREASED APPROPRIATIONS FOR EXISTING RECURRING PROGRAMS ABOVE THE RATE OF INFLATION, TO PROHIBIT SUBSEQUENT APPROPRIATIONS FOR SUCH PROGRAMS FOR FOUR YEARS IF THE PreviousANNUALNext MEASURE OF PROGRESS IS NOT MET, AND TO REQUIRE THESE STATEMENTS TO BE APPROVED BY A JOINT STANDING COMMITTEE AND TO PROVIDE FOR ITS MEMBERSHIP.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 7, Title 2 of the 1976 Code is amended by adding:

    "Section 2-7-79.    (A)    Any appropriations proposed in the PreviousannualNext general appropriations bill, including by way of amendment, for a new recurring program or expense, or additional appropriations for an existing recurring program or expense above the rate of inflation, must include a statement prepared by the primary sponsor detailing the objectives of the program, the target date of meeting the objectives, and appropriate PreviousannualNext measures for determining progress toward the objectives. If the PreviousannualNext measure of progress is not attained, the appropriation, or amount of the appropriation above the inflation rate, may not be included in the next four succeeding appropriation acts.

    (B)    For any provision in the Previousannual general appropriations bill or any amendment thereto requiring the statement provided in subsection (A) to be in order, the statement must have received at least a two-thirds majority vote of a joint standing committee hereby established of the House of Representatives and the Senate, consisting of twelve members, six members of which must be appointed respectively by the Speaker of the House and the President of the Senate."

SECTION    2.    This act takes effect July 1, 2001.
