A Bill to amend Sections 46-41-10, 46-41-20, 46-41-30, 46-41-60, 46-41-90 and
46-41-170, Code of Laws of South Carolina, 1976, relating to dealers and
handlers of agricultural products, so as to define "dealer in agricultural
products" to include any person licensed as a dealer in agricultural products;
to delete an exception from licensing requirements for persons who submit
financial statements acceptable to the Commissioner of Agriculture; to
increase the amount of the surety bond required of applicants for a dealer's
license from Three thousand dollars to Five thousand dollars or in an amount
equal to the maximum amount of business estimated to be done in any thirty-day
period by the applicant; to provide that no dealer's accounts payable shall
exceed the amount of his surety bond; to authorize the Commissioner to monitor
bonding requirements monthly; to provide that, when payment of consigned goods
sold by a dealer is not paid within ten days, a copy of the contract or
written agreement authorizing the payment to be made later than ten days after
sale shall be forwarded to the Commissioner; to increase the penalties for
violations for a first offense from One thousand dollars to Ten thousand
dollars and for a second or subsequent offense from Three thousand dollars to
Fifty thousand dollars.
