THE COMMITTEE ON JUDICIARY
To whom was referred a Bill (H. 4513), to amend the Code of Laws of South Carolina, 1976, by adding Section 2-20-80 so as to prohibit, under certain conditions, a member of the General Assembly from being elected to a nonjudicial office, etc., respectfully
REPORT:
That they have duly and carefully considered the same, and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking all after the enacting words and inserting:
/ SECTION 1. The 1976 Code is amended by adding:
"Section 2-20-80. Notwithstanding any other provision of law, for all nonjudicial offices elected by the General Assembly, no member of the General Assembly may be elected to the office while he is serving in the General Assembly nor may that person be elected to a nonjudicial office for a period of one year after he either:
(1) ceases to be a member of the General Assembly; or
(2) fails to file for election to the General Assembly in accordance with Section 7-11-15."
SECTION 2. This act takes effect upon approval by the Governor. /

Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 2-20-80. No member of the General Assembly may be elected to a nonjudicial office filled by election by the General Assembly while he is serving in the General Assembly nor may that person be elected to a nonjudicial office for a period of one year after he either:
(1) ceases to be a member of the General Assembly; or
(2) fails to file for election to the General Assembly in accordance with Section 7-11-15."
SECTION 2. This act takes effect upon approval by the Governor.
