A Bill to amend the Code of Laws of South Carolina, 1976, by adding Section
50-17-425, so as to provide that licenses for captains or masters of trawling
vessels and owners of fish, shrimp, or crab boats must be applied for between
January 1 and February 1 of any year, except for owners who purchase or
construct a vessel after January 31 of any year or when a captain of a
licensed vessel is changed; and to amend Section 50-17-410, relating to
licenses for owners of fish, shrimp, or crab boats, so as to increase
nonresident trawler license fees from seventy-five dollars plus one hundred
twenty-five dollars to seventy-five dollars plus two hundred twenty-five

AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION
50-17-425, SO AS TO PROVIDE THAT LICENSES FOR CAPTAINS OR MASTERS OF TRAWLING
VESSELS AND OWNERS OF FISH, SHRIMP, OR CRAB BOATS MUST BE APPLIED FOR BETWEEN
JANUARY 1 AND FEBRUARY 1 OF ANY YEAR, EXCEPT FOR OWNERS WHO PURCHASE OR CONSTRUCT
A VESSEL AFTER JANUARY 31 OF ANY YEAR OR WHEN A CAPTAIN OF A LICENSED VESSEL IS
CHANGED; AND TO AMEND SECTION 50-17-410, RELATING TO LICENSES FOR OWNERS OF FISH,
SHRIMP, OR CRAB BOATS, SO AS TO INCREASE NONRESIDENT TRAWLER LICENSE FEES FROM
SEVENTY-FIVE DOLLARS PLUS ONE HUNDRED TWENTY-FIVE DOLLARS TO SEVENTY-FIVE DOLLARS
PLUS TWO HUNDRED TWENTY-FIVE DOLLARS.
Be it enacted by the General Assembly of the State of South Carolina:
Applications for license
SECTION 1. The 1976 Code is amended by adding:
"Section 50-17-425. Applications for licenses provided for under Sections
50-17-330 and 50-17-410 must be received between January 1 and February 1 for the
license period beginning July 1 of that year. Payment of required license fees
received before or after the dates specified must not be accepted and must be
returned.
Persons who purchase or construct a vessel after January 31 of any year are
eligible for the licenses referred to under this section, if they apply and
submit payment of the specified fees within forty-five days of the date of
purchase, or completion of construction of the vessel, and submit a bill of sale,
documentation papers, or other validation that the Division may require. If it
becomes necessary to change the captain of a licensed vessel at any time, the
person who replaces him may acquire a captain's license under Section
50-17-330."
License required
SECTION 2. The second paragraph of Section 50-17-410 of the 1976 Code is amended
to read:
"All owners of shrimp and crab trawling boats who are nonresidents of this
State shall, before operating the boats in the waters of this State, secure a
license for each boat as required of residents under the preceding paragraph,
upon payment of the like sum of seventy-five dollars for each boat so licensed
and shall, in addition, pay a fee of two hundred twenty-five dollars."
Time effective
SECTION 3. This act shall take effect upon approval by the Governor. |
