A Bill to amend Section 1-13-40, as amended, Code of Laws of South Carolina,
1976, relating to the South Carolina Human Affairs Commission, so as to reduce
the membership from nineteen to seventeen members, to alter the representation
of the membership, and to require the Governor to appoint an at large member
as chairman.

AN ACT TO AMEND SECTION 1-13-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA,
1976, RELATING TO THE SOUTH CAROLINA HUMAN AFFAIRS COMMISSION, SO AS TO
REDUCE THE MEMBERSHIP FROM NINETEEN TO SEVENTEEN MEMBERS, TO ALTER THE
REPRESENTATION OF THE MEMBERSHIP, AND TO REQUIRE THE GOVERNOR TO APPOINT AN
AT LARGE MEMBER AS CHAIRMAN.
Be it enacted by the General Assembly of the State of South Carolina:
Human Affairs Commission created
SECTION 1. Subsection (a) of Section 1-13-40 of the 1976 Code is amended to read:
"(a) There is hereby created in the executive department the South Carolina Human Affairs
Commission, to encourage fair treatment for, and to eliminate and prevent discrimination against, any
member of a group protected by this chapter, and to foster mutual understanding and respect among all people
in this State."
Composition of Commission
SECTION 2. Subsection (b) of Section 1-13-40 of the 1976 Code, as last amended by Act 24 of 1979, is
further amended to read:
"(b) The Commission shall consist of seventeen members, with two members from each congressional
district appointed by the Governor, with the advice and consent of the Senate, three members at large
appointed by the Governor, one member from the Senate appointed by the President of the Senate and one
member from the House of Representatives appointed by the Speaker. The first appointed members from the
first and second congressional districts and one at large member shall serve until June, 1984. The first
appointed members from the third and fourth congressional districts and one at large member shall serve until
June, 1985. Thereafter all members shall serve for a term of three years with the exception of the two
legislative members, who shall be appointed for one year commencing at the beginning of the annual session
of the General Assembly and until their successors are appointed and qualify. Vacancies shall be filled in
the manner of the original appointment for the unexpired term."
Appointment of chairman and vice-chairman
SECTION 3. Subsection (d) of Section 1-13-40 of the 1976 Code is amended to read:
"(d) The Governor shall appoint one of the at large members to serve as chairman and may appoint
any member to serve as vice-chairman, each to serve a term of one year. In the absence of appointment of
a vice-chairman, the members may elect one of their number to fill that office. The Commission may elect
other officers from among its members as necessary, except that the Commissioner may be elected to serve
as secretary."
Time effective
SECTION 4. This act shall take effect upon approval by the Governor. |
