A BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976,
BY ADDING SECTION 44-43-925 SO AS TO PROVIDE AN ORGAN
AND TISSUE CERTIFICATION FORM TO FACILITATE THE
RECOVERY OF ORGANS AND TISSUES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 44-43-925. In addition to the donation form
authorized pursuant to Section 44-43-120, the following form may be
used by hospitals and procurement agencies to facilitate the recovery of
organs and tissues. A potential donor may choose to adopt a declaration
substantially in the following form:
ORGAN AND TISSUE DONOR CERTIFICATION:
Notwithstanding a previous declaration relative to the withholding or
withdrawal of life-prolonging procedures, I desire to donate my organs
or tissues as specifically designated below. I direct my attending
physician to take the necessary measures to accomplish my desire as
indicated. By initialing the following lines and signing this certification
I specifically make this anatomical gift, if medically acceptable, to take
effect upon my death.
_____ I desire to donate my organs or tissues for transplantation.
_____ I desire to donate the following organs or tissues for
transplantation: _________________.
_____ If the above organs or tissues are medically unacceptable
for transplantation, I authorize their use for medical research or
educational purposes.
_____ I do not desire to donate my organs or tissues for
transplantation or research.

SECTION 2. This act takes effect upon approval by the Governor.
