A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-21-180 SO AS TO PROVIDE REQUIREMENTS FOR PUBLIC BOATING ACCESS FACILITIES.

Whereas, public boating access facilities provided by the State and local governing bodies are essential for access to public waterways. These facilities support our state's recreational and tourism industry; and

Whereas, public boating access facilities provide emergency access to waterways during severe weather and for law enforcement search and recovery. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-21-180. Plans to improve existing public boating access facilities or to construct new facilities must be based on an appropriate boating needs assessment study by the Wildlife and Marine Resources Department and must be designed to meet the identified need in accordance with recognized engineering design for the facilities. Reasonable measures must be taken to avoid and minimize impact to the environment including, but not limited to, appropriate erosion control and stormwater management to the extent the measures are consistent with the intended use of the facility. Public boating access facilities which meet the requirements of this section are deemed to be consistent with applicable law and regulations governing the design and construction of these facilities without further modifications."

SECTION 2. This act takes effect upon approval by the Governor.
