AN ACT TO ESTABLISH THE LANCASTER COUNTY SCHOOL DISTRICT, TO ESTABLISH
SINGLE-MEMBER ELECTION DISTRICTS FOR THE ELECTION OF TRUSTEES, TO ABOLISH THE
COUNTY BOARD OF EDUCATION AND THE DISTRICT SUPERINTENDENT OF EDUCATION AND
DEVOLVE THEIR DUTIES AND RESPONSIBILITIES UPON THE BOARD OF TRUSTEES; AND TO
REPEAL ACT 848 OF 1976 RELATING TO THE ELECTION AND COMPOSITION OF THE LANCASTER
COUNTY BOARD OF EDUCATION AND THE AREA BOARDS OF TRUSTEES OF THE SCHOOL DISTRICT
OF THE COUNTY.
Be it enacted by the General Assembly of the State of South Carolina:
School district created
SECTION 1. There is created the Lancaster County School District, a body
politic and corporate with a governing body known as the Lancaster County School
District Board of Trustees. The district is vested with all the rights,
privileges, and responsibilities as other school districts possess under the
provisions of the general law of South Carolina. The area and boundaries of the
district are the same as the area and boundaries of the county.
Composition of board
SECTION 2. Beginning with the certification of the members of the board of
trustees elected at the time of the general election of 1988, the Lancaster
County School District Board of Trustees shall consist of nine members who must
be elected from single-member election districts as provided in Section 3. The
terms of all present at-large members expire at that time. However, the four
members of the current Lancaster County School Board of Education who represent
Andrew Jackson, Buford, Indian Land, and Lancaster area boards of trustees shall
holdover and be members of the Lancaster County School District until the
successors to the members elected from Districts 2, 4, 6, and 8 are elected in
the general election of 1990 as provided in this section. An election of the
trustees must be held at the time of the general election in 1988. The members
first elected after the effective date of this act from Districts 2, 4, 6, and
8 shall serve until their successors are elected in the general election of 1990.
The members first elected after the effective date of this act from Districts 1,
3, 5, 7, and 9 shall serve until their successors are elected in the general
election of 1992. At the 1990 general election, the members must be elected for
terms of four years and until their successors are elected and qualify. The
candidate receiving the highest number of the votes in each district in the
general election must be declared elected. Vacancies on the board must be filled
by special election if the vacancy occurs ninety days or more prior to the
general election. If the vacancy occurs less than ninety days prior to the
general election, the vacancy may not be filled.

SECTION 3. The Lancaster County School District Board of Trustees must be
elected from each of the following single-member election districts:

Superintendent and board abolished
SECTION 4. Effective with the certification of the board of trustees elected
at the general election of 1988, the office of the County Superintendent of
Education for Lancaster County and the Lancaster County Board of Education are
abolished and all powers and duties exercised previously by the superintendent
and the board of education are devolved upon the Lancaster County School District
Board of Trustees. The Lancaster County School District Board of Trustees has
the power to appoint a district superintendent of education.
Office to be declared vacant
SECTION 5. If a member of the board moves his residence from the election area
from which he was elected, his office becomes vacant automatically and his
successor must be chosen in the manner prescribed in Section 2.
Candidates
SECTION 6. All persons desiring to qualify as a candidate for election to the
board of trustees shall file with the county election commission a statement of
candidacy at least forty-five days before the general election. The county
election commission shall conduct and supervise all elections for members of the
board in the manner governed by the election laws of this State, mutatis mutandi.
The commission shall prepare a nonpartisan ballot to be used for the election of
all members of the board which shall comply substantially with the provisions of
Article 3, Chapter 13, Title 7 of the 1976 Code, appoint managers for the voting
precincts, and do all things necessary to carry out the election, including the
counting of ballots and declaring the results. The commission shall advertise
the date of the election sixty days preceding the election in a newspaper of
general circulation published in Lancaster County and shall publish a second
notice two weeks thereafter. The members of the board of trustees shall take
office upon the certification of their election.
Title to property
SECTION 7. Title to all school property in Lancaster County, real or personal,
which is used for school purposes, as well as that which may be acquired after
the effective date of this act, is vested in the school district of Lancaster
County.
Repealed
SECTION 8. Act 848 of 1976 is repealed.
Time effective
SECTION 9. This act takes effect upon approval by the Governor. |
