A BILL
TO AMEND CHAPTER 1, TITLE 51, CODE OF LAWS OF SOUTH
CAROLINA, 1976, RELATING TO THE SOUTH CAROLINA
DEPARTMENT OF PARKS, RECREATION AND TOURISM, SO AS
TO TRANSFER THE PATRIOT'S POINT NAVAL AND MARITIME
MUSEUM FROM THE CONTROL OF THE PATRIOT'S POINT
DEVELOPMENT AUTHORITY TO THE DEPARTMENT OF
PARKS, RECREATION AND TOURISM, AND TO DEFINE WHAT
COMPOSES THE MUSEUM.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 51 of the 1976 Code is amended by
adding:
"Section 51-1-65. Ownership and control of the Patriot's Point
Naval and Maritime Museum is transferred from the Patriot's Point
Development Authority to the South Carolina Department of Parks,
Recreation and Tourism. This museum is composed of the real property
under and adjacent to the six naval ships and of the real property being
used for the operation of the museum, gift shop, and adjacent parking
area operated by the authority, including any buildings located on this
property.
This real property is described generally as a piece of property whose
boundary on the north is the southernmost boundary of the property
currently leased by the authority to the South Carolina Department of
Youth Services; whose boundary on the east is the current paved road
on the property; whose boundary on the south is a line set forth in a
survey by E.M. Seabrook, Jr., dated May 5, 1989, which delineates the
separation of the ship area from the partially constructed hotel on land
owned by the authority as designated in the survey; and whose boundary
on the west is Charleston Harbor. This museum property also includes
the two islands which are identified as area J and area I on the plat
prepared by E.M. Seabrook, Jr., dated May 5, 1989. The museum also
includes six United States naval vessels: the Yorktown, Laffey,
Savannah, Clamagore, Ingham, and Comanche. Also included in the
museum is the tract of roughly 36.18 acres of land which is designated
as parcel C on the plat prepared by E.M. Seabrook, Jr., dated May 5,
1989."
SECTION 2. Section 51-1-60 of the 1976 Code is amended by
adding appropriately numbered subitems to read:
"( ) The commission is instructed to continue to develop and
operate a national naval museum of ships , naval and maritime
equipment, artifacts, books, manuscripts, art, and historical materials for
the education and enjoyment of the people of our nation and to instill in
them a knowledge of our naval and maritime history and of the
importance of sea power to our economy and defense. In order to enable
the commission to carry out the purposes of the museum, the
commission may acquire, construct, maintain, equip and operate docks,
ships , piers, quays, and other structures and any and all facilities needed
for the convenient use of them, including the dredging of approaches
thereto, and the construction of roads and highways thereon, and bridges
and causeways necessary for use thereof, including a marina, except
these piers, ships , docks, quays, or similar structures shall be used
exclusively for fulfilling the educational, recreational, and tourist
missions of the museum and shall not be used for any active ocean-going
cargo or passenger vessels.
( ) To accept funds, other assets, and services from Charleston
County and municipalities located therein, the State of South Carolina
and any other person or organization, and to use them in such manner,
within the purposes of the commission, as shall be stipulated by the
county or the State in any matter coming within the general purposes of
the commission regarding the national naval museum."
SECTION 3. Section 51-13-760 of the 1976 Code is amended to
read:
"Section 51-13-760. The authority is created as an
instrumentality of the State for the accomplishment of the following
general purposes, all or any of them, which are intended to broaden and
not to restrict any other powers given to it in this article, namely:
(1) To develop and improve the Patriot's Point area to provide a place
of education and recreation to foster among the people pride and
patriotism in our nation and its heritage;
(2) To establish and develop a National Naval Museum of ships,
naval and maritime equipment, artifacts, books, manuscripts, art and
historical materials for the education and enjoyment of the people of our
nation and to instill in them a knowledge of our naval and maritime
history; and of the importance of sea power to our economy and defense;
(3) (2) To foster and stimulate national and international
travel to and participation in the development of Patriot's Point, by
acquiring, constructing, equipping and maintaining museum buildings,
seaquariums and laboratories, public exhibits and entertainment
facilities, historical monuments and sites; and providing lodging and
accommodations for travelers by land or water to Patriot's Point;
(4) (3) To cooperate with the State of South Carolina and the
United States of America, and any agency or any department,
corporation or instrumentality thereof, in the maintenance, development,
improvement and use of Patriot's Point and all its functions;
(5) (4) To accept funds, other assets and services from
Charleston County and municipalities located therein and the State of
South Carolina, and to use them in such manner, within the purposes of
the authority, as shall be stipulated by the county or the State in any
matter coming within the general purposes of the authority;
(6) (5) To act as agent for the United States of America, or
any agency, department, corporation or instrumentality thereof, in any
matter coming within the purposes of the authority;
(7) (6) In general to do and perform any act or function which
may tend to or be useful toward the development and improvement of
Patriot's Point."
SECTION 4. This act takes effect upon approval by the Governor.
