AN ACT TO AMEND SECTION 50-17-450, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO WHOLESALE SEAFOOD DEALERS AND LAND AND SELL LICENSE REQUIREMENTS, SO AS TO REQUIRE A LAND AND SELL LICENSE FOR ANY FISHERMAN WHO SELLS HIS CATCH TO WHOLESALE SEAFOOD DEALERS.

Be it enacted by the General Assembly of the State of South Carolina:

Wholesale seafood dealers' license

SECTION 1. Section 50-17-450, of the 1976 Code, as last amended by Section 3 of Act 165 of 1981, is further amended to read:

"Section 50-17-450. Any person engaged in buying, bartering, shippingNext, shucking, processing, or selling at other than retail any fish or fishery products must first obtain from the Division of Marine Resources a wholesale seafood dealer's license upon payment of a fee of fifty dollars. The license is in addition to those enumerated in Section 50-17-410. Each person engaged in buying, bartering, or handling fresh saltwater fish or fisheries products for the purpose of resale at other than retail, whether handled on a commission basis or otherwise, or Previousshipping them out of the State on consignment or order is considered a wholesale dealer. Any fisherman who sells his catch to wholesale dealers licensed under this section must obtain from the Division an individual land and sell license, the fee for which is twenty-five dollars. This license is not required of persons licensed under Section 50-17-330. Any person who takes saltwater fish and sells his catch to other than a licensed wholesale dealer is considered a wholesale dealer himself."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
