A BILL

TO AMEND SECTION 48-48-140, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO IMPOSITION AND DISTRIBUTION OF TAXES ON LOW-LEVEL RADIOACTIVE WASTE DISPOSAL, SO AS TO PROVIDE THAT THE TAX MUST BE BASED ON PER CUBIC FOOT OR PER CURIE, WHICHEVER AMOUNT IS GREATER, AND TO ESTABLISH THE TAX AMOUNT PER CURIE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 48-48-140(A) of the 1976 Code, as added by Act 145 of 1995, Part II, Section 79, is amended to read:

"(A) There is imposed a tax on each shipment of low-level radioactive waste disposed of in this State of two hundred thirty-five dollars a cubic foot on each cubic foot of low-level radioactive waste disposed of in this State or three hundred ninety-two dollars a curie on each curie, whichever is greater. The revenues resulting from the provisions of this section must be used for the South Carolina Educational Assistance Endowment Fund as reflected in appropriations to the State Treasurer in Part I, Section 10 of the 1995-96 general appropriations act and as thereafter provided, except as provided in subsection (C)."

SECTION 2. This act takes effect upon approval by the Governor.
