AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-5-1707 SO AS TO PROVIDE FOR LIMITS ON SPECIFIED SHARKS; AND TO AMEND SECTION 50-5-2725, AS AMENDED, RELATING TO SHARK CATCH LIMITS, SO AS TO FURTHER PROVIDE FOR CERTAIN FEDERAL PROVISIONS WHICH APPLY TO THE TAKING OF SHARKS.

Be it enacted by the General Assembly of the State of South Carolina:

Limits

SECTION    1.    Chapter 5, Title 50 of the 1976 Code is amended by adding:

"Section 50-5-1707.    (A)    When taken for other than a commercial purpose, it is lawful to take or have in possession in the waters of this State in any one day no more than:

(1)    two Atlantic sharpnose sharks (Rhizoprionodon terraenovae) per person;

(2)    one bonnethead shark (Sphyrna tiburo) per person.

(B)    A bonnethead shark taken lawfully in state waters for other than a commercial purpose may be of any size.

(C)    The species named in this section must be brought to the dock or landed with head and tail fin intact.

(D)    Returning fish named in this section to the water if taken in excess of the limits does not constitute a violation."

Federal provisions which apply

SECTION    2.    Section 50-5-2725(A) of the 1976 Code, as last amended by Act 342 of 2002, is further amended to read:

"(A)    Except as provided in this chapter, the size, catch, bag, and possession limits, fishing period closures, and requirements pertaining to the taking, release, landing, sale, purchase, trade, or barter of sharks or shark parts prescribed by those federal regulations implemented under the Fishery Conservation and Management Act (PL 94-265) and pertaining to the Fishery Management Plan for Atlantic tuna, swordfish, and sharks are declared to be the law of this State and apply in state waters; provided, however, no federal recreational angling permit or federal charter boat/head boat permit is required for the taking or possession of sharks in the waters of this State. In state waters size, catch, bag, and possession limits pertain to individual fishermen when no vessel is utilized."

Time effective

SECTION    3.    This act takes effect upon approval by the Governor.

Ratified the 19th day of March, 2003.

Approved the 20th day of March, 2003.
