A BILL

TO AMEND SECTION 8-13-740, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REPRESENTATION OF PreviousANOTHER PERSON BY A PUBLIC OFFICIAL, MEMBER, OR EMPLOYEE BEFORE A GOVERNMENTAL ENTITY, SO AS TO AUTHORIZE A MEMBER OF THE FIRM FOR WHICH THE MEMBER IS ASSOCIATED OR EMPLOYED TO APPEAR BEFORE THE GOVERNMENTAL ENTITY UNDER CERTAIN CONDITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 8-13-740 of the 1976 Code, as last amended by Act 6 of 1995, is further by adding at the end:

"(D)    The provisions of this section do not apply to a member of a governmental entity or a member of the member's firm who appears before the governmental entity if the member gives notice of a possible conflict and recuses himself from a vote."

SECTION    2.    This act takes effect upon approval by the Governor.
