AN ACT TO CREATE THE JOINT LIAISON COMMITTEE ON SMALL BUSINESS AND PROVIDE FOR MEMBERSHIP, DUTIES, AND FUNCTIONS; AND TO AMEND ACT 608 OF 1978, AS ANIENDED, RELATING TO THE SYSTEM FOR REVIEWING, TERMINATING, AND REESTABLISHING STATE AGENCIES, BOARDS, DEPARTMENTS, AND COMMISSIONS, SO AS TO PROVIDE THAT JUNE 30,1987, IS THE TERMINATION DATE FOR THIS JOINT LIAISON COMMITTEE ON SMALL BUSINESS AS WELL AS CERTAIN OTHER STATE BOARDS.

Be it enacted by the General Assembly of the State of South Carolina:

Legislative findings

SECTION 1. The General Assembly finds that small business is an integral part of the state economy, providing economic diversification and job creation. It further finds that the majority of the state's private labor force is employed by small businesses and that the majority of all new jobs in the State are created by small businesses. It further finds that it is the responsibility of the General Assembly to support and foster small business assistance and development. For the above reasons, the General Assembly has determined to enact the provisions of this act.

Committee created

SECTION 2. There is created a nine member joint committee of the General Assembly to be known as the Joint Liaison Committee on Small Business. Two members must be appointed from the Senate Labor, Commerce and Industry Committee by the chairman thereof and two members must be appointed from the House Labor, Commerce and Industry Committee by the chairman thereof. One member must be appointed from Senate Finance Committee by the chairman thereof and one member must be appointed from the House Ways and Means Committee by the chairman thereof. One member must be appointed by the Governor which member shall represent the small business community. Additionally, the chairman of the Governor's Small and Minority Business Expansion Council and the chairman of the State Development Board shall serve ex officio and may designate persons to represent them at meetings of the committee. Terms of the legislative members of the committee are coterminous with their elected terms as members of the General Assembly. The term of the member appointed by the Governor representing the small business community shall be for four years and until his successor is appointed and qualifies. Vacancies must be filled in the manner of original appointment for the remainder of the unexpired term.

Responsibilities of committee

SECTION 3. The committee is charged with the responsibility of conducting a continuous review of the problems confronting small businesses generally, reporting annually to the General Assembly, and making legislative recommendations to the General Assembly when appropriate. In addition, the committee has the following specific duties:

1. To review the laws and regulations of this State regarding small business formation and, if appropriate, to make recommendations to the General Assembly for revision.

2. To review the laws and regulations of this State regarding reporting requirements to state agencies and commissions, and, if appropriate, to make recommendations to the General Assembly for revision,

3. To review small business assistance efforts in other states, and, if appropriate, to make recommendations to the General Assembly for implementation.

4. To review the small business assistance efforts of all state agencies, boards, and commissions, and all federal and private entities in a manner so as to encourage a coordination of efforts.

Meetings of committee

SECTION 4. The members of the committee shall meet as soon as practicable after their appointment and shall elect a chairman, vice-chairman, and other officers as they consider necessary. The committee at its first meeting shall also adopt rules for the purpose of governing its internal proceedings. The committee shall meet at least quarterly and at other times as may be designated by the chairman.

Members of the committee shall receive the usual mileage, per diem, and subsistence as provided by law for members of state boards, commissions, and committees to be paid from approved accounts from both houses.

All other expenses of the committee must be defrayed from the budget of the State Development Board, which shall also provide staff support and assistance to the committee.

Termination date

SECTION 5. Item (B) of Section 6 of Act 608 of 1978 is amended to read:

"(B) June 30, 1987, is the termination date for:

(1) Board of Pharmaceutical Examiners

(2) Board of Medical Examiners

(3) Board of Dentistry

(4) Board of Veterinary Medical Examiners

(5) Board of Nursing

(6) Board of Chiropractic Examiners

(7) joint of Liason Committee on Small Business

Time effective

SECTION 6. This act shall take effect upon approval by the Governor.
