 A Bill to amend the Code of Laws of South Carolina, 1976, by adding Section
 8-11-57 so as to establish a thirty-five dollar rate of subsistence for
 members of state boards, commissions, and committees and to establish a cap of
 seventy-nine dollars when the member is reimbursed for actual expenses
 incurred on official business; and to amend Section 2-3-30, relating to
 subsistence expenses for members of the General Assembly, so as to provide for
 actual expenses not to exceed seventy-nine dollars a day.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-57 SO AS TO ESTABLISH A THIRTY-FIVE DOLLAR RATE OF SUBSISTENCE FOR MEMBERS OF STATE BOARDS, COMMISSIONS, AND COMMITTEES AND TO ESTABLISH A CAP OF SEVENTY-NINE DOLLARS WHEN THE MEMBER IS REIMBURSED FOR ACTUAL EXPENSES INCURRED ON OFFICIAL BUSINESS; AND TO AMEND SECTION 2-3-30, RELATING TO SUBSISTENCE EXPENSES FOR MEMBERS OF THE GENERAL ASSEMBLY, SO AS TO PROVIDE THAT SUBSISTENCE EXPENSES MUST BE PAID FOR ACTUAL EXPENSES NOT TO EXCEED SEVENTY-NINE DOLLARS A DAY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 8-11-57. Members of state boards, commissions, or committees whose duties are not full time, who are away from their residences on official business, and who are paid on a per diem basis are allowed subsistence expenses of thirty-five dollars a day or in lieu of subsistence may receive reimbursement for actual expenses for meals and lodging, not to exceed seventy-nine dollars a day."

SECTION 2. Section 2-3-30 of the 1976 Code is amended to read:

"Section 2-3-30. Except for legislative days which, by Senate or House action, are designated for consideration only of local and uncontested matters, members of the General Assembly, including the Lieutenant Governor, shall be paid fifty ($50.00) dollars subsistence expenses for each legislative day. Provided, such subsistence allowance shall be paid for each calendar day occurring within the same legislative day to members of that body in session on each calendar day.

Members of the General Assembly, including the Lieutenant Governor, shall receive subsistence expenses for actual documented expenses not to exceed seventy-nine dollars a day for each legislative day that the respective body is in statewide session and in any other instance in which a member is allowed subsistence expenses. No member of the General Assembly except those present are eligible for subsistence on that day."

SECTION 3. This act takes effect upon approval by the Governor.
