A BILL

TO AMEND SECTION 30-4-80, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO NOTICE OF MEETINGS OF PUBLIC BODIES, SO AS TO REQUIRE PUBLIC BODIES WHICH MAINTAIN INTERNET WEBSITES TO POST THE NOTICE OF THE REGULAR, CALLED, SPECIAL, OR RESCHEDULED MEETINGS ON THE SITE AND TO PROVIDE TIME FRAMES; AND TO AMEND SECTION 30-4-90, RELATING TO MINUTES OF MEETINGS OF PUBLIC BODIES, SO AS TO REQUIRE PUBLIC BODIES WHICH MAINTAIN INTERNET WEBSITES, TO POST THE MINUTES WITHIN FIVE DAYS AFTER THEY ARE ADOPTED AND TO KEEP THE MINUTES ON THE SITE FOR THE NEXT THIRTY DAYS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 30-4-80 of the 1976 Code is amended by adding:

"(f) If a public body maintains an internet website, it must give notice on the site of the dates, times, and places of its regular meetings at the beginning of each calendar year. The agenda, if any, for a regularly scheduled meeting must be posted on the site at least twenty-four hours before the meeting. The notice for any called, special, or rescheduled meeting must be posted on the site as early as practicable, but not later than twenty-four hours before the meeting. The notice must include the agenda, date, time, and place of the meeting. This requirement does not apply to emergency meetings of public bodies."

SECTION 2. Section 30-4-90(b) of the 1976 Code is amended to read:

"(b) The minutes shall be are public records and shall must be available within a reasonable time after the meeting except where such the disclosures would be inconsistent with Section 30-4-70 of this chapter. If a public body maintains an internet website, the minutes must be posted to the site within five days after they are adopted and remain on the site for the next thirty days."

SECTION 3. This act takes effect upon approval by the Governor.
