AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 30-9-75 SO AS TO PROVIDE THAT IN ALL PreviousCASESNext WHERE INDICES AFFECTING REAL PROPERTY ARE REQUIRED TO BE MAINTAINED IN THE OFFICES OF THE CLERK OF COURT OR REGISTER OF MESNE CONVEYANCES AND WHERE THESE INDICES ARE MAINTAINED BY ELECTRONIC OR COMPUTER MEANS, THE CLERK OF COURT OR REGISTER OF MESNE CONVEYANCES SHALL PROVIDE AT LEAST A SECOND OR BACKUP COPY OF THE INDICES WHICH MUST BE AVAILABLE FOR USE BY THE PUBLIC IN THE EVENT OF DESTRUCTION OR UNAVAILABILITY OF THE ELECTRONIC INDICES.

Be it enacted by the General Assembly of the State of South Carolina:

Backup copy of computer indices

SECTION 1. Chapter 9, Title 30 of the 1976 Code is amended by adding:

"Section 30-9-75. In all Previouscases where indices affecting real property are required to be maintained in the offices of the clerk of court or register of mesne conveyances and where these indices are maintained by electronic or computer means, the clerk of court or register of mesne conveyances shall provide at least a second or backup copy of the indices which must be available for use by the public in the event of destruction or unavailability of the electronic indices."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
