AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING CHAPTER 27
TO TITLE 56 SO AS TO PROVIDE FOR THE REGULATION OF PROFESSIONAL HOUSEMOVING BY
THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AND TO PROVIDE PENALTIES FOR
VIOLATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
Regulation of professional housemoving
SECTION 1. The 1976 Code is amended by adding to Title 56:
"CHAPTER 27
Professional Housemoving
Section 56-27-10. As used in this chapter:
(a) 'Person' means an individual, corporation, partnership, association, or
any other business entity.
(b) 'House' means a dwelling, building, or other structure in excess of
fourteen feet in width.
(c) 'Department' means the Department of Highways and Public Transportation.
Section 56-27-20. All persons who engage in the profession of housemoving on
roads and highways of this State must be licensed by the department.
Section 56-27-30. A license issued under the provisions of this chapter is
effective for a period of one year from the date of issuance and is renewable on
an annual basis. The annual and renewal fee for the license is twenty-five
dollars. All persons issued licenses under the provisions of this chapter are
required to carry the license on their persons at all times when engaged in the
profession of housemoving on the roads and highways of this State.
Section 56-27-40. (a) No license may be issued or renewed pursuant to this
chapter unless the applicant presents to the department a certificate of
insurance from an insurance company licensed to do business in this State
providing:
(1) Motor vehicle insurance with minimum coverage of one hundred thousand
dollars for bodily injury to or death of one person in any one accident, three
hundred thousand dollars for bodily injury to or death of two or more persons in
any one accident, and fifty thousand dollars for injury to or destruction of
property of others in any one accident.
(2) Comprehensive general liability insurance with a minimum coverage of two
hundred fifty thousand dollars combined single limit of liability.
(3) Workers' Compensation insurance that complies with Title 42 if the person
licensed as a professional housemover is not exempt from the provisions of that
title.
(b) The certificate shall provide for continuous coverage during the effective
period of the license issued pursuant to this chapter.
Section 56-27-50. Any person violating the provisions of this chapter is deemed
guilty of a misdemeanor and upon conviction must be fined:
(a) Not less than one hundred dollars for a first offense;
(b) Not less than five hundred dollars for a second offense;
(c) Not less than one thousand dollars for a third or subsequent
offense."
