TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 40-11-255 AND 40-59-252, SO AS TO CREATE A VOLUNTEER LICENSE FOR RETIRED CONTRACTORS AND RESIDENTIAL HOME BUILDERS, RESPECTIVELY, TO USE IN DONATING THEIR SERVICES TO CHARITABLE ORGANIZATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 40-11-255. A volunteer license may be issued by the board without a fee to a retired contractor who has been granted inactive status and who has engaged in general construction not less than twenty-five years or until age sixty-five after a minimum of fifteen years of having performed general construction and who wishes to donate general construction services through a charitable organization approved by the board, if the retired contractor files a proper application on a form provided by the board satisfactorily demonstrating the retired contractor has been on the official inactive status list for not more than ten years. A volunteer license authorizes the retired contractor to provide general construction services to others without remuneration of any kind through one specifically identified charitable organization only. A volunteer license is not transferable. A separate application must be filed and a separate license must be issued for every charitable organization to which the retired contractor wishes to donate these services. A volunteer license may be renewed annually upon application for an indefinite number of years, if the volunteer license has been renewed annually without interruption with the same charitable organization and all other qualifications have been met. The board may promulgate any additional regulations as necessary to carry out the provisions of this section."

SECTION 2. The 1976 Code is amended by adding:

"Section 40-59-252. A volunteer license may be issued by the board without a fee to a retired residential home builder or residential specialty contractor who has engaged in residential building or residential specialty contracting, respectively, not less than twenty-five years or until age sixty-five after a minimum of fifteen years of engaging in such building or specialty contracting or specialty contractor, and who wishes to donate building or specialty contracting services through a charitable organization approved by the board, if the retired builder or specialty contractor files a proper application on a form provided by the board satisfactorily demonstrating that the retired builder or specialty contractor has been licensed pursuant to this article within the past ten years. A volunteer license authorizes the retired residential home builder or specialty contractor to provide services to others without remuneration of any kind through one specifically identified charitable organization only. A volunteer license is not transferable. A separate application must be filed and a separate license must be issued for every charitable organization to which the retired builder or specialty contractor wishes to donate these services. A volunteer license may be renewed annually upon application and may be renewed for an indefinite number of years, if the volunteer license has been renewed annually without interruption with the same charitable organization and all other qualifications have been met. The board may promulgate any additional regulations as necessary to carry out the provisions of this section."

SECTION 3. This act takes effect upon approval by the Governor.
