TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-19-Previous455Next SO AS TO PROHIBIT CERTAIN ENUMERATED ACTIVITIES AT LAKE WILLIAM C. BOWEN, LAKE BLALOCK, AND SPARTANBURG MUNICIPAL RESERVOIR #1 IN SPARTANBURG COUNTY; AND TO REPEAL ACT 465 OF 2002 RELATING TO THE ESTABLISHMENT OF THE SAFETY AND SECURITY DEPARTMENT WITHIN THE COMMISSION OF PUBLIC WORKS FOR THE CITY OF SPARTANBURG.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 10, Chapter 19, Title 50 of the 1976 Code is amended by adding:

"Section 50-19-Previous455.    (A)    Notwithstanding another provision of law, it is unlawful for a person to hunt, possess a firearm, or discharge fireworks on or immediately adjacent to the waters of Lake William C. Bowen or Spartanburg Municipal Reservoir #1 in Spartanburg County.

(B)    Notwithstanding another provision of law, it is unlawful for a person to possess a firearm, unless the possession is incident to the lawful hunting of migratory waterfowl, or to discharge fireworks on or immediately adjacent to the waters of Lake Blalock in Spartanburg County.

(C)    Any person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be punished as follows:

(1)    for a first offense by a fine of not less than twenty-five dollars nor more than one hundred dollars or by imprisonment of not less than ten days nor more than thirty days;

(2)    for a second offense by a fine of not less than fifty dollars nor more than one hundred dollars or by imprisonment of not less than fifteen days nor more than thirty days; and

(3)    for a third offense by a fine of not less than two hundred dollars or by imprisonment of not less than thirty days, in the discretion of the court having jurisdiction."

SECTION    2.    Act 465 of 2002 is repealed.

SECTION    3.    This act takes effect upon approval by the Governor.
