A BILL
TO AMEND SECTION 12-31-250, AS AMENDED, CODE OF LAWS
OF SOUTH CAROLINA, 1976, RELATING TO REGISTRATION
CARDS AND IDENTIFICATION MARKERS FOR MOTOR
CARRIERS OPERATING MOTOR VEHICLES IN THIS STATE FOR
PURPOSES OF THE ROAD TAX, SO AS TO REDUCE FROM
FIFTY-FIVE PERCENT TO THIRTY PERCENT THE AMOUNT OF
THE ANNUAL REGISTRATION FEE CREDITED TO THE STATE
HIGHWAY FUND.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The second paragraph of Section 12-31-250 of the 1976
Code, as amended by Section 33, Part II, Act 189 of 1989, is further
amended to read:
"No card or marker may be issued by the Tax Commission
until after the fee provided in this section is paid. Fifty-five
Thirty percent of the fees provided for by this section must be
credited to the state highway fund. The remaining portion of the fees
must be deposited in the state treasury and distributed annually by the
State Treasurer to municipalities as follows:
(1) three-fifths must be distributed to municipalities pro rata,
according to population as shown by the most recent United States
census. In each annual distribution of these funds, each county seat
shall must receive two thousand dollars or its share
according to population, whichever is greater; and no municipality may
receive more than ten thousand dollars in any annual
distribution; and
(2) two-fifths must be distributed to municipalities pro rata
according to population as shown by the most recent United States
census. There may be no deduction from the funds distributed to
municipalities for costs of collection and administration."
SECTION 2. Upon approval by the Governor, this act is effective
beginning with distributions made for the 1990-91 fiscal year.
