A Bill to amend Section 40-43-90, Code of Laws of South Carolina, 1976,
relating to reciprocal licenses granted by the Board of Pharmaceutical
Examiners to pharmacists who are also registered in another state, so as to
increase the fee for such reciprocal licenses; to amend Section 40-43-230,
relating to the renewal of licenses of pharmacists and assistant pharmacists,
so as to further provide for such renewal including an increase in the fees
therefor; and to amend Section 40-43-240, relating to the annual registration
of pharmacists and also the reports required to be submitted to the Board
regarding changes in the pharmacist's business and employment, so as to
further provide for the circumstances which require such reports and to
eliminate certain references to annual registration.-at

AN ACT TO AMEND SECTION 40-43-90, AS AMENDED, CODE OF LAWS OF SOUTH
CAROLINA,
1976, RELATING TO RECIPROCAL LICENSES GRANTED BY THE BOARD OF
PHARMACEUTICAL
EXAMINERS TO PHARMACISTS WHO ARE ALSO REGISTERED IN ANOTHER STATE,
SO AS TO
INCREASE THE FEE FOR SUCH RECIPROCAL LICENSES; TO AMEND SECTION
40-43-230,
RELATING TO THE RENEWAL OF LICENSES OF PHARMACISTS AND ASSISTANT
PHARMACISTS,
SO AS TO FURTHER PROVIDE FOR SUCH RENEWAL INCLUDING AN INCREASE IN
THE FEES
THEREFORE; AND TO AMEND SECTION 40-43-240, RELATING TO THE ANNUAL
REGISTRATION
OF PHARMACISTS AND ALSO THE REPORTS REQUIRED TO BE SUBMITTED TO THE
BOARD
REGARDING CHANGES IN THE PHARMACIST'S BUSINESS AND EMPLOYMENT, SO
AS TO
FURTHER PROVIDE FOR THE CIRCUMSTANCES WHICH REQUIRE SUCH REPORTS
AND TO
ELIMINATE CERTAIN REFERENCES TO ANNUAL REGISTRATION.
Be it enacted by the General Assembly of the State of South Carolina:
Board may grant certificates of registration
Section 1. Section 40-43-90 of the 1976 Code is amended by inserting after
"hundred"
on the last
line "eighty". The section when amended shall read:
"Section 40-43-90. The Board of Pharmaceutical Examiners, in its discretion, may grant
certificates of
registration as pharmacists to such persons as shall furnish with their applications
satisfactory proof that they
have been registered by examination in some other state requiring at the time of such
registration a degree of
competency equal to that required of an applicant in this State at that time. The fee for
granting a reciprocal
license shall be one hundred eighty dollars."
Fee
Section 2. Section 40-43-230 of the 1976 Code is amended to read:
"Section 40-43-230. Every person holding a license as pharmacist or assistant pharmacist
shall pay to
the secretary or inspector on or before the first day of July in each year a renewal fee of
twenty-five dollars for
which a renewal certificate for one year shall be issued. In case any person defaults for more
than sixty days after
the first of July in each year in paying such renewal fee and securing a renewal license
certificate a penalty of fifty
dollars must be paid for such default. In case such default shall continue for one year or more
then a penalty of
one hundred dollars must be pard and collected in addition to the renewal fee before issuing a
renewal license.
If the delinquency continues for more than two years then the original license shall be
cancelled. Upon payment
of a penalty of one hundred fifty dollars and the renewal fees due, the Board may restore such
defaulting member
if otherwise in good standing."
Notification of Change of Address
Section 3. Section 40-43-240 of the 1976 Code is amended to read:
"Section 40-43-240. Whenever any registered pharmacist in the employ of or in charge of
the
pharmaceutical duties of a drug store or pharmacy within this State leaves the employ of or
ceases to have charge
of the pharmaceutical duties of such drug store or pharmacy, he shall within five days, notify
the secretary of the
Board in writing of such change, giving the name and address of the drug store or pharmacy in
which his services
have terminated. Likewise, whenever any registered pharmacist within this State makes any
change
in his
employment from one drug store or pharmacy to another, he shall, within five days, notify the
secretary of the
Board of such change, listing the name and address of the drug store or pharmacy in which he was
last employed,
and to which he expects to move."
Time effective
Section 4. This act shall take effect upon the approval by the Governor. |
