AN ACT TO ESTABLISH SINGLE-MEMBER ELECTION DISTRICTS FOR THE SCHOOL BOARD OF AIKEN COUNTY, PROVIDE FOR THE ELECTION OF ITS MEMBERS, ESTABLISH THE TERMS, PROVIDE THAT A SPECIAL ELECTION MUST BE HELD FOLLOWING NOTIFICATION OF PRECLEARANCE FROM THE UNITED STATES JUSTICE DEPARTMENT TO ELECT MEMBERS OF THE BOARD, PROVIDE FOR A TRANSITION PERIOD FOR MEMBERS ELECTED AT THAT TIME AND THEREAFTER, PROVIDE FOR THE FILLING OF VACANCIES, AND PROVIDE A METHOD BY WHICH CANDIDATES NAMES ARE PLACED ON THE BALLOT.
Be it enacted by the General Assembly of the State of South Carolina:
Election districts defined
SECTION 1. One member of the Aiken County School Board must reside in and be elected from each of the following defined single-member election districts for terms of four years by the electors within each election district:

Transition provisions
SECTION 2. (A) Terms of members of the Aiken County Board of Education are for four years and until their successors are elected and qualify, except to effect orderly transition and staggered
terms, the initial election must be conducted as follows:
(1) candidates from districts 1, 4, 8, and 9 must be elected in a special election to be conducted in accordance with the provisions of subsection (D) of this act for terms to expire when their successors are elected and qualify at the time of the general election in 1988. After the 1988 election, candidates from districts 1, 4, 8, and 9 must be elected for terms of four years;
(2) candidates from districts 2, 3, 5, 6, and 7 must be elected in a special election to be conducted in accordance with the provisions of subsection (D) of this act for terms to expire when their successors are elected and qualify at the time of the general election in 1990. After the 1990 election, candidates from districts 2, 3, 5, 6, and 7 must be elected for terms of four years.
(B) A vacancy in the office of any member of the board must be filled in the manner provided in Section 7-13-190(c).
(C) The Aiken County election commissioners shall conduct the election, canvass the vote, and certify the results. Managers in each precinct for the general election shall serve as managers of the board of education election. The laws of the general election shall apply except as otherwise specified in this section. The Aiken County Election Commission shall list as a candidate any qualified resident elector upon showing that fifty or more electors of the geographical area of the district for which an individual offers as a candidate have signed a request that his name be listed. A ballot separate from general election ballots must be provided at each precinct where the election is held by the Aiken County Election Commission.
(D) One week after notification of preclearance
from the United States Department of Justice, notice of the special election provided in this section must be given in a newspaper of general circulation in Aiken County for one week. The filing must be opened at noon on the Friday following the last day of publication of the notice of the special election and close ten days later at noon. The filing must be made to the same entity to which the nonpartisan officeholders would normally file for office in a general election year. The election must be set for the thirteenth Tuesday after the close of filing. The election may not be set earlier than August 25, 1987. If the filing period closes on a state holiday, then the filing must be held open through the succeeding weekday. If the date for the election falls on a state holiday, it must be set for the next succeeding Tuesday.
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
