AN ACT TO AMEND ACT 256 OF 1981, AS AMENDED, RELATING TO THE SCHOOL DISTRICT OF MARLBORO COUNTY, SO AS TO REQUIRE CANDIDATES FOR THE SCHOOL BOARD TO FILE THE WRITTEN NOTICE OF CANDIDACY BY PreviousAUGUSTNext FIRST OF EACH GENERAL ELECTION YEAR RATHER THAN THIRTY DAYS BEFORE THE ELECTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The first paragraph of Section 6 of Act 256 of 1981, as last amended by Act 611 of 1992, is further amended to read:

"One member of the Marlboro County Board of Education must be elected from each of the eight single-member election districts as provided for in Section 5 of this act and in addition the chairman is the ninth member of the board and must be elected from the school district at large by the qualified electors of the school district. The office of chairman is a separate office and a person desiring to run for chairman specifically shall file and run for the office. The member of the board elected from each single-member election district must be a resident of that district and must be elected by the qualified electors of that district. A person desiring to qualify as a candidate and be elected to the board from a specific district or as chairman shall file written notice of candidacy with the county election commission no later than twelve o'clock noon on PreviousAugustNext first of each election year, or if PreviousAugust first falls on Sunday, not later than twelve o'clock noon on the following Monday. This notice of candidacy must be a sworn statement and must include the candidate's name, age, voting precinct, single-member election district in which the candidate resides, period of residence in the election district, and other information the county election commission requires."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
