TO AMEND SECTION 7-13-190, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONDUCTING A SPECIAL ELECTION TO FILL A VACANCY IN OFFICE, SO AS TO PROVIDE AN ALTERNATE PROCEDURE IN EVEN-NUMBERED YEARS WHEN THE ELECTION TO FILL THE VACANCY FALLS AFTER THE FIRST THURSDAY IN JUNE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 7-13-190 of the 1976 Code, as last amended by Act 3 of 2003, is further amended by adding at the end:

"Notwithstanding the provisions of this section, in even-numbered years, when the special election to fill the vacancy under the provisions of this section is scheduled to be held after the first Thursday in June, the provisions of this paragraph must be followed for all partisan elections. Filing opens for these candidates on the third Tuesday of June at twelve o'clock noon and closes ten days later at twelve o'clock noon. If the filing period closes on a state holiday, then filing must be held open through the succeeding weekday. If seeking nomination by petition, the verification provisions of subsection (B) apply. If seeking nomination by political party primary or convention, the filing must be with the appropriate official as provided in Section 7-11-15 and if seeking nomination by petition, filing with the appropriate official is the same as provided in Section 7-11-70. A primary must be held on the first Tuesday in August. A runoff must be held two weeks later. The special election must be on the first Tuesday in November."

SECTION    2.    This act takes effect upon approval by the Governor.
