AN ACT TO ESTABLISH FIVE SINGLE MEMBER ELECTION DISTRICTS FROM WHICH CERTAIN MEMBERS OF YORK SCHOOL DISTRICT 1 OF YORK COUNTY MUST RESIDE AND BE ELECTED BY THE QUALIFIED ELECTORS OF EACH DISTRICT, PROVIDE THAT TWO MEMBERS MUST BE ELECTED AT LARGE FROM THE SCHOOL DISTRICT, PROVIDE A SCHEDULE FOR THE ELECTION OF TRUSTEES, THE METHOD OF DETERMINING CANDIDATES, AND A PROCEDURE FOR FILLING VACANCIES.

Be it enacted by the General Assembly of the State of South Carolina:

Election districts; procedures for electing trustees

SECTION 1. (A) Notwithstanding any other provisions of law, beginning with the election conducted in 2000, the election districts for the members of the Board of Trustees of York School District 1 of York County are established as follows:

(B)(1) The Board of Trustees of York School District 1 of York County is composed of seven members elected in a nonpartisan election by the qualified electors of the district with five members required to reside in and be elected by the qualified electors of each of the five districts delineated in subsection (A) of this section and two elected at large from the district without regard to residency.

(2) The trustees representing districts 1, 3, and 5 and one at-large seat must be elected at the time of the general election of 2000, and the trustees presently residing in districts 2 and 4 and one at-large seat whose terms expire in 2000 must be elected at the time of the general election of 2002. Trustees serving on the effective date of this act, elected from residency districts 2 and 4 and the at-large seat shall continue to serve until the expiration of their terms in 2002. Thereafter, all terms of office are for four years, until their successors are elected and qualify.

(3) Notwithstanding any other provisions of law, beginning with elections conducted in 1996, each candidate for election as a trustee to the school boards in York County School Districts 1, 2, 3, and 4 must file his statement of candidacy with the Registration and Elections Commission for York County for the period beginning no earlier than 12:00 noon on AugustNext first and ending no later than 12:00 noon on PreviousAugust thirty-first. However, if either of these dates falls on a Saturday, Sunday, or legal holiday, the date is extended until 12:00 noon of the next succeeding day which is not a Saturday, Sunday, or legal holiday.

(4) The balloting shall take place at the general election precincts located in the school district and conducted according to the laws and regulations governing elections, mutatis mutandis. In each election, those candidates receiving the most votes are declared elected and no run-off is required. All newly elected members of the board shall take office on December first following their election.

(5) If a seat becomes vacant before the expiration of the incumbent's term of office due to death, resignation, removal, or any other cause, the resulting vacancy must be filled by the board of trustees for the unexpired portion of the term until the next election for trustees is held.

Boundaries of district

SECTION 2. The boundaries of School District 1 in York County are not altered by the provisions of this act. These school district lines are as defined by law and any census blocks which may be divided are done so only for statistical purposes and to establish a population base.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
