AN ACT TO PROVIDE FOR FEES AND COSTS FOR THE SHERIFF OF NEWBERRY COUNTY AND REPEAL A PORTION OF ACT 74 OF 1949 WHICH WAS CODIFIED AS SECTION 27-410 OF THE 1962 CODE RELATING TO SHERIFF'S FEES AND COSTS.
Be it enacted by the General Assembly of the State of South Carolina:
Fees and costs
SECTION 1. The following fees and costs shall be charged and collected by the sheriff of Newberry County:
"Serving every writ, summons, notice or rule not otherwise
specified, besides mileage $ 15.00
Mileage from sheriff's office to defendant's or witness'
residence or place where found, going and returning each way, per mile .16
The sheriff shall charge mileage for only the actual number
of miles traveled by himself or deputy and in case more
than one party or witness in the same case or parties of
witnesses in different cases are served on one trip the mileage fee
herein provided shall be prorated and charged according to the number
of parties served.
Serving subpoena writ 5.00
Levying execution, besides mileage, 27% of recovery value up if redemption is made prior to and including $300.00 sheriff's sale 1.75% of recovery value over $300.00
Selling land under decree of court,
in lieu of commissions and all other
charges except the printer's bill for
advertising 27% of value recovered
Selling personal property after levy,
in lieu of commission and all other
charges except the printer's bill for
advertising 27% of value recovered"
Repeal
SECTION 2. That portion of subsection (3) of Section 1 of Act 74 of 1949 which was codified as Section 27-410 of the 1962 Code, entitled "Fees of Sheriff" is repealed.
Time effective
SECTION 3. This act shall take effect upon approval by the Governor.
