TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION
48-39-148 SO AS TO AUTHORIZE BUSINESSES WITH A DECK, DOCK, OR OTHER STRUCTURE
LOCATED IN A CRITICAL AREA TO USE THE STRUCTURE FOR PURPOSES DIRECTLY RELATED
TO THE OPERATION OF THE BUSINESS WITH LOCAL ZONING APPROVAL.
Amend Title To Conform
Be it enacted by the
General Assembly of the State of South Carolina:
SECTION 1. Chapter 39, Title 48 of the S.C. Code is amended by
adding:
Section
48-39-148. Notwithstanding any other provision of law to the contrary, a
business that contains a grandfathered or permitted commercial deck or marina
that is located in a critical area may utilize the deck or marina for the
purpose of allowing patrons of the business to consume food and beverages. The
provision of this section does not authorize a kitchen, food preparation area,
or bar on the deck or marina.
SECTION 2. This act takes effect upon approval
by the Governor.
