 A Bill to amend Act 245 of 1983, as amended, relating to budgets of school
 districts in Orangeburg County, so as to provide that in School Districts 3
 and 8 tax millage may be increased by no more than twelve mills and in School
 Districts 1, 2, 4, 5, 6, and 7 increased by no more than five mills above the
 inflation factor prescribed by the South Carolina Education Improvement Act of
 1984 without a referendum, and to require a referendum if the increase exceeds
 the five or twelve mills limitations.

AN ACT TO AMEND ACT 245 OF 1983, AS AMENDED, RELATING TO BUDGETS OF SCHOOL DISTRICTS IN ORANGEBURG COUNTY, SO AS TO PROVIDE THAT IN SCHOOL DISTRICTS 3 AND 8 TAX MILLAGE MAY BE INCREASED BY NO MORE THAN TWELVE MILLS AND IN SCHOOLS DISTRICTS 1, 2, 4, 5, 6, AND 7 INCREASED BY NO MORE THAN FIVE MILLS ABOVE THE INFLATION FACTOR PRESCRIBED BY THE SOUTH CAROLINA EDUCATION IMPROVEMENT ACT OF 1984 WITHOUT A REFERENDUM, AND TO REQUIRE A REFERENDUM IF THE INCREASE EXCEEDS THE FIVE OR TWELVE MILLS LIMITATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

Budget to be prepared

SECTION 1. Section 1 of Act 245 of 1983, as last amended by Act 288 of 1985, is further amended to read:

"Section 1. The Board of Trustees of the school districts in Orangeburg County, on or before the last day of June of 1986, shall prepare a school district budget for the ensuing school year. On or before the first day of September of 1986, each board of trustees shall notify the county auditor and treasurer in writing of the millage required for the operation of the schools in its respective district for the 1986-87 school year. The notice by each board constitutes authority for the levying and collection of the millage upon all of the real and personal property within the respective school district. The levy must be placed to the credit of the district in which it is levied and expended within that district only. Orangeburg County School Districts Nos. 3 and 8 may not raise their millage by more than twelve mills and Orangeburg County School Districts Nos. 1, 2, 4, 5, 6, and 7 may not raise their millage by more than five mills above the inflation factor prescribed in the South Carolina Educational Improvement Act of 1984 unless a majority of the registered electors of the particular district voting in a referendum called by the district board of trustees and conducted by the county election commission, vote in favor of the millage increase budget becoming effective."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
