AN ACT TO AMEND SECTIONS 7-15-320 AND 7-15-340, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PERSONS QUALIFIED TO VOTE BY ABSENTEE BALLOT, SO AS TO ADD PERSONS SEVENTY-TWO YEARS OF AGE OR OLDER; AND TO AMEND SECTION 7-11-70, RELATING TO A POLITICAL PARTY HOLDING A PRESIDENTIAL PRIMARY ELECTION, SO AS TO PROVIDE FOR ABSENTEE BALLOTS THEREFOR UNDER CERTAIN CONDITIONS IF THE PRESIDENTIAL PRIMARY IS HELD ON A SATURDAY.

Be it enacted by the General Assembly of the State of South Carolina:

Persons seventy-two or older qualify

SECTION 1. Section 7-15-320 of the 1976 Code, as last amended by Act 193 of 1989, is further amended by adding an appropriately numbered item to read:

"( ) persons seventy-two years of age or older."

SECTION 2. Section 7-15-340 of the 1976 Code, as last amended by Act 356 of 1990, is further amended by adding an appropriately numbered item to read:

"( ) Persons seventy-two years of age or older."

Absentee ballots if presidential primary on Saturday

SECTION 3. The second paragraph of Section 7-11-20 of the 1976 Code, as added by Act 47 of 1991, is further amended to read:

"A certified political party wishing to hold a presidential primary election may do so in accordance with the provisions of this title and party rules. However, notwithstanding any other provision of this title, the state committee of the party shall set the date and the hours that the polls will be open for the presidential primary election and the filing requirements. If a party holds a presidential primary election on a Saturday, an absentee ballot must be provided to a person who signs an affirmation stating that for religious reasons he does not wish to take part in the electoral process on a Saturday."

Time effective

SECTION 4. This act takes effect upon approval by the Governor.
