A Bill to amend Section 56-5-1620, Code of Laws of South Carolina, 1976,
relating to penalties for racing a motor vehicle, so as to increase the
penalties, provide for confiscation, forfeiture, and sale of the vehicle, and
conform certain provisions for drivers and persons who acquiesce in or permit
driving when a motor vehicle is raced.

A BILL
TO AMEND SECTION 56-5-1620, CODE OF LAWS OF SOUTH
CAROLINA, RELATING TO PENALTIES FOR RACING A MOTOR
VEHICLE, SO AS TO INCREASE THE PENALTIES, PROVIDE FOR
CONFISCATION, FORFEITURE, AND SALE OF THE VEHICLE,
AND CONFORM CERTAIN PROVISIONS FOR DRIVERS AND
PERSONS WHO ACQUIESCE IN OR PERMIT DRIVING WHEN A
MOTOR VEHICLE IS RACED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-5-1620 of the 1976 Code is amended to
read:
"Section 56-5-1620. (A) Any A
person violating the provisions of Sections 56-5-1590 to
56-5-1620 by driving a motor vehicle shall, upon conviction,
must be fined not less than two four hundred
dollars nor more than six eight hundred dollars
or imprisoned for not less than two months four
nor more than six months, or both, in the discretion of the trial
judge court. In addition to such the
penalty the driver of any vehicle who violates the provisions of
Sections 56-5-1590 to 56-5-1620 shall upon conviction, entry of a plea
of guilty or forfeiture of bail must have his driver's license
revoked suspended for a period of one year
eighteen months, and his vehicle must be confiscated, forfeited to
the State, and sold pursuant to Section 56-5-6240.
(B) Any A person violating the
provisions of Sections 56-5-1590 to 56-5-1620 by acquiescing in or
permitting the driving of his car shall, upon conviction,
must be fined not to exceed one more than two
hundred dollars or imprisoned for a period not to exceed
thirty days more than two months, or both, in the discretion
of the court and, in. In addition thereto,
shall to the penalty he must have his driver's license and the
registration of his vehicle suspended for a period of three six
months."
SECTION 2. This act takes effect upon approval by the Governor.
