A Bill to amend Section 58-27-1530, Code of Laws of South Carolina, 1976,
relating to the prohibition against any electric light or power wire being
erected within fifty yards of any public highway unless it meets certain
standards, so as to provide that no electrical light and power wires,
transmission lines, or systems capable of transmitting more than fifty
kilovolts of electricity may be placed within two hundred fifty yards of any
public or private school, vocational or technical school, or institution of
higher learning, and to provide certain civil penalties for violation.

A BILL
TO AMEND SECTION 58-27-1530, CODE OF LAWS OF SOUTH
CAROLINA, 1976, RELATING TO THE PROHIBITION AGAINST
ANY ELECTRIC LIGHT OR POWER WIRE BEING ERECTED
WITHIN FIFTY YARDS OF ANY PUBLIC HIGHWAY UNLESS IT
MEETS CERTAIN STANDARDS, SO AS TO PROVIDE THAT NO
ELECTRICAL LIGHT AND POWER WIRES, TRANSMISSION
LINES, OR SYSTEMS CAPABLE OF TRANSMITTING MORE
THAN FIFTY KILOVOLTS OF ELECTRICITY MAY BE PLACED
WITHIN TWO HUNDRED FIFTY YARDS OF ANY PUBLIC OR
PRIVATE SCHOOL, VOCATIONAL OR TECHNICAL SCHOOL, OR
INSTITUTION OF HIGHER LEARNING, AND TO PROVIDE
CERTAIN CIVIL PENALTIES FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 58-27-1530 of the 1976 Code is amended to
read:
"Section 58-27-1530. (A) No electric light or
power wire shall may be erected or maintained within
fifty yards of any public road or highway in this State, unless it be
so is constructed, erected, and maintained and
provided with sufficient lightning guards or arresters, automatic
cut-offs, and other devices as may be necessary for the
protection of persons and property. Any person erecting or maintaining
any such wire in violation of the provisions hereof of this
section shall forfeit and pay as a penalty therefor five
dollars a day for each day such the violation continues
after the expiration of thirty days from the date on which he may
have has been given a written notice specifying the fault
or defect in the manner of erection, construction, or
maintenance thereof. Such This penalty may be
recovered at the suit of any citizen in any county in which such
the violation shall occur and the sum so recovered, after paying
therefrom all the expenses incurred in the prosecution of such
the suit, shall must be paid into the county
treasury for such that county for ordinary county
purposes.
(B) (1) In addition to the other provisions of this section,
no electrical light and power wires, transmission lines, or systems
capable of transmitting more than fifty kilovolts of electricity may be
erected, placed, or constructed, whether above or below ground, within
two hundred fifty yards of any public or private school, vocational or
technical school, or institution of higher learning.
(2) Any person violating the provisions of this subsection is
subject to the penalty provisions of subsection (A) in the same manner
and under the same conditions that the penalty provided in subsection
(A) may be imposed against persons violating that subsection.
(3) The provisions of this subsection apply only to those electrical
light and power wires, transmission lines, or systems erected after the
effective date of this subsection."
SECTION 2. This act takes effect upon approval by the Governor.
