A BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976,
BY ADDING SECTION 16-3-65 SO AS TO ESTABLISH THE
CRIME OF RECKLESS ENDANGERMENT AND PROVIDE A
PENALTY FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-3-65. A person who causes bodily harm to or
endangers the bodily safety of another person by consciously
disregarding a substantial and unjustifiable risk that his act or omission
will cause harm or endanger the safety of the other person and his act
or omission constitutes a gross deviation from the standard of care
which a reasonable person would exercise in the situation is guilty of
the misdemeanor of reckless endangerment. Upon conviction, the
person must be fined not more than five thousand dollars or
imprisoned not more than three years or both."
SECTION 2. This act takes effect upon approval by the Governor.
