A Bill to amend Sections 23-8-10, 23-8-20, and 23-8-30, Code of Laws of South
Carolina, 1976, relating to the State Fire Commission, so as to reduce the
Commission membership from nineteen to eighteen members by deleting the fire
chief elected at large by the General Assembly who serves as chairman and
providing that the Commission shall elect the chairman, to provide that the
consumer representative on the Commission may not be from one of the
professions mandated for other Board members, and to provide that the State
Budget and Control Board may require the State Fire Commission to recommend
additional candidates for State Fire Marshal and to delete references to the
rejection of candidates.

A BILL
TO AMEND SECTIONS 23-8-10, 23-8-20, AND 23-8-30, CODE OF
LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE STATE
FIRE COMMISSION, SO AS TO REDUCE THE COMMISSION
MEMBERSHIP FROM NINETEEN TO EIGHTEEN MEMBERS BY
DELETING THE FIRE CHIEF ELECTED AT LARGE BY THE
GENERAL ASSEMBLY WHO SERVES AS CHAIRMAN AND
PROVIDING THAT THE COMMISSION SHALL ELECT THE
CHAIRMAN, TO PROVIDE THAT THE CONSUMER
REPRESENTATIVE ON THE COMMISSION MAY NOT BE FROM
ONE OF THE PROFESSIONS MANDATED FOR OTHER BOARD
MEMBERS, AND TO PROVIDE THAT THE STATE BUDGET AND
CONTROL BOARD MAY REQUIRE THE STATE FIRE
COMMISSION TO RECOMMEND ADDITIONAL CANDIDATES
FOR STATE FIRE MARSHAL AND TO DELETE REFERENCES TO
THE REJECTION OF CANDIDATES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The first paragraph of Section 23-8-10 of the 1976 Code
is amended to read:
"There is hereby created the South Carolina State Fire
Commission to be composed of nineteen
eighteen residents of the State eighteen of whom shall
be appointed by the Governor upon the advice and consent of the
Senate as follows: two members shall must be
appointed from each congressional district with one from each district
being a volunteer fireman and one from each district being a full-time
professional fireman but in no event shall the two from each
district may not be appointed from the same county; one
shall must be a registered architect; one shall
must be a local government building official; one shall
must be an electrical inspector; one shall must
be a licensed contractor; one shall must be a fire
protection engineer, and one shall must be a
consumer. The other member shall be a fire chief elected from the
State at large by the General Assembly and shall serve as chairman.
The consumer representative may not be from any of the professions
required to be represented on the commission."
SECTION 2. Section 23-8-20 of the 1976 Code is amended to read:
"Section 23-8-20. The members shall receive such
the mileage, subsistence, and per diem as
provided by law for members of boards, committees, and
commissions for attendance at commission meetings or when engaged
in business of the commission payable from such appropriations
made from the general fund of the State upon the issuance of vouchers
signed by the chairman.
The commission shall meet at least once each quarter and at
such other times upon call of the chairman. The commission
shall elect such a chairman and other officers as
it deems considers necessary at the first meeting in each
year and shall adopt appropriate rules of procedure. Ten members
shall constitute a quorum for the conduct of business.
The State Budget and Control Board shall provide
administrative support and such other assistance as may be necessary to
carry out the purposes of this Chapter."
SECTION 3. Section 23-8-30(B) of the 1976 Code is amended to read:
"(B) To recommend to the State Budget and Control
Board a list of qualified candidates for the position of State Fire Marshal
from which the State Fire Marshal shall must be hired.
The Budget and Control Board board may reject all
candidates on the list and require the submission of
commission to submit such additional more candidates
as the board considers appropriate."
SECTION 4. Sections 1 and 2 of this act take effect May 31, 1993.
Section 3 of this act takes effect upon approval by the Governor.
