A JOINT RESOLUTION AUTHORIZING THE OFFICE OF
INDIGENT DEFENSE FOR FISCAL YEAR 1997-98 ONLY TO USE
UP TO FIVE HUNDRED THOUSAND DOLLARS OF THE DEATH
PENALTY TRIAL FUND TO PAY FEES AND EXPENSES IN
NONCAPITAL CASES IF THE CONFLICT FUND IS EXHAUSTED.
Be it enacted by the General Assembly of the State of South Carolina:
Funds for indigent defense
SECTION 1. For Fiscal Year 1997-98 only, of the funds
appropriated to the Office of Indigent Defense for Fiscal Year 1997-98
pursuant to Paragraph 14.1, Section 14, Part IB of Act 155 of 1997, the
Office of Indigent Defense, if the Conflict Fund has been exhausted, may
use up to five hundred thousand dollars from the Death Penalty Trial Fund
to pay fees and expenses in noncapital cases pursuant to Section 17-3-50
of the 1976 Code.
Time effective
SECTION 2. This joint resolution takes effect upon approval by
the Governor.
